Defendant sentenced for trespassing
David Diaz Jr., 41, Minot, recently changed his plea in North Central District Court to guilty to criminal trespass-dwelling, a Class C felony, in connection with an incident on May 12.
According to court records, a female reported a trespass at her house at about 4:30 a.m. She told officers she was woken up from her sleep by a man she recognized as Diaz. She said she had known Diaz for about seven years but had made it clear Diaz was not to be in her residence.
She told the responding officer that she had believed Diaz had jumped the fence into her yard, which was still secured from the inside, and entered her unlocked garage door. According to her report, Diaz had mentioned trying to return something to her but had left immediately when yelled at to leave.
A warrant was issued for Diaz, and he had his initial appearance on May 20.
District Judge Gary Lee sentenced Diaz on Sept. 4 to 360 days supervised probation, ordered him to have no contact with the victim and imposed a fine of $525.
