Man sentenced after domestic violence incident

A Belcourt man was sentenced in North Central District Court on Tuesday after a guilty plea was entered for domestic violence-serious bodily injury.

The charge stemmed from an incident on Oct. 13, 2023, when Whitley Herald, 21, Belcourt, was reportedly yelling and throwing things inside a southeast Minot apartment.

According to an affidavit of probable cause, officers with the Minot Police Department were dispatched to the scene. According to the officers, Herald was “very intoxicated” and requested to be placed under arrest while placing his hands behind his back. While speaking with the victim, it became apparent there was a domestic dispute. The incident escalated to Herald choking the victim. Herald was placed under arrest and transported to the hospital for medical clearance. He was then transported to Ward County Jail.

Judge Douglas Mattson sentenced Herald to complete an in-person domestic violence course, a chemical dependency evaluation, one year supervised probation, 360 days confinement with 27 days credit for time served and three days good time, and $525 fines/fees. This offense was deemed a misdemeanor.
