Defendant sentenced for fentanyl distribution

A Hazen man has been sentenced to time served after entering a change of plea to guilty to one count of Class B felony possession of fentanyl with intent to deliver.

Dustin Paul Bumbalough, 25, Hazen, entered his change of plea to the charge in North Central District Court on Friday, while two other counts of possession with intent to deliver heroin, a Class B felony, and unlawful possession of drug paraphernalia, a Class A misdemeanor, were dismissed in accordance with a plea agreement.

Bumbalough was charged on March 6 after being arrested at the Minot Amtrak Passenger Station by the Ward County Narcotics Task Force.

According to court documents, the task force received a tip from a Metro Area Task Force officer in Bismarck that Bumbalough was set to arrive in Minot by train that evening. Bumbalough was identified by task force officers as he exited the train carrying two backpacks, a large suitcase and other bags.

Bumbalough’s luggage was searched after he was detained, leading to the discovery of fentanyl pills, fentanyl powder, suspected heroin and various drug paraphernalia.

Judge Todd Cresap sentenced Bumbalough to serve 122 days of a 10-year sentence with the Department of Corrections and Rehabilitation, with credit for 122 days already served. Cresap ordered Bumbalough to complete two years of supervised probation along with a chemical dependency evaluation. Bumbalough was also assessed $775 in court fines and fees.
