Concurrent sentence after guilty pleas

A Minot man has been sentenced to a concurrent sentence in four separate cases in North Central District Court after pleading guilty to some in exchange for several dismissals and reductions.

Shelby Michael Kvaal, 30, Minot, entered his change of pleas in the four cases before Judge Richard Hagar in Minot on March 20.

In the first case from July 4, 2023, Kvaal pleaded guilty to one Class C felony count of theft-take- $1,000-$10,000 while a Class A misdemeanor charge of driving under suspension-fourth or subsequent offense in five years was dismissed. Hagar sentenced Kvaal to serve one year and one day of a five-year sentence in the Department of Corrections and Rehabilitation (DCR), with credit for 112 days already served. Kvaal was also ordered to have no contact with the victim or his residence, and was assessed $525 in court fines and fees along with $3,354.76 in restitution. An indigent recoupment fee of $575 was waived by the court.

The second case against Kvaal heard at the March 20 hearing was dated Nov. 16, 2023, where he was charged with fleeing a peace officer-second or subsequent offense, possession of controlled substance-fentanyl-second offense, unlawful possession of drug paraphernalia-second offense, all Class C felonies, and driving under suspension-fourth or subsequent offense in five years, a Class A misdemeanor. The counts of fleeing, paraphernalia possession, and driving under suspension were dismissed in accordance with the plea agreement, with Brooks pleading guilty to the fentanyl possession charge. Hagar sentenced Brooks to a concurrent sentence with the first case of one year and one day of a five-year sentence in the DCR, and gave him credit for 100 days already served. Brooks was ordered to complete two years of supervised probation in addition to a chemical dependency evaluation. Hagar also assessed court fines and fees of $525.

The third sentence against Kvaal stemmed from a charge of possession of a schedule IV depressant-second offense from July 28, 2023. Hagar handed down an identical concurrent sentence to the second case with the same probation and evaluation requirements, and court fines and fees of $525. Kvaal was given credit for 104 days already served.

The fourth case proceeded with Kvaal entering guilty pleas for felony possession of drug paraphernalia and possession of less than half an ounce of marijuana, an infraction. Two additional charges of marijuana paraphernalia possession and possession of fentanyl-second offense were dismissed. The felony paraphernalia possession charge was deemed a misdemeanor by the court due to Hagar sentencing Kvaal to serve only 103 days of a 360 day sentence in the DCR. Kvaal was given credit for 103 days already served and will be required to complete two years of supervised probation. Fees of $525 were also assessed.
