Burlington man faces charges in sex abuse case

A Burlington man charged with multiple sex-related felonies in August recently was charged with nine more felonies for possession of child sexual abuse material (CSAM).

Noble Tart Jhonson, 19, Burlington, was arrested on Aug. 30 for four counts of possession of CSAM, a Class C felony, and promoting an obscene sexual performance by a minor and gross sexual imposition, both Class A felonies.

Investigators with the Ward County Sheriff’s Department and the Bureau of Criminal Investigation charged Jhonson after receiving a tip from the National Center for Missing and Exploited Children (NCMEC), which alerted them to a report from an online chat application. Investigators determined that the IP address from which the CSAM originated was allegedly that of an address in Burlington.

Investigators determined that Jhonson lived at the residence and interviewed him, during which he allegedly admitted to using internet sites to receive and exchange CSAM. Jhonson’s phone was seized and allegedly was found to contain a video of him sexually assaulting a toddler. When confronted, Jhonson allegedly admitted to performing the act on two occasions over a three- month period while babysitting the child.

Jhonson was granted a cash and surety bond of $100,000 by North Central District Court Judge Stacey Louser and pleaded not guilty at his preliminary hearing on Oct. 1. Louser’s bail conditions included denial of access to the internet and requirements that he have no contact with the alleged victim nor any minor child and be subject to GPS monitoring.

While the proceedings were ongoing for these initial charges, NCMEC sent another tip to law enforcement for additional sharing of CSAM by an online account on Aug. 21, before his arrest. This account was determined to have used the same alleged IP address and physical address in Burlington connected to the original charges against Jhonson. The nine video files allegedly contained various forms of CSAM, involving children as young as 5 years old.

Jhonson made his initial appearance on these new charges Tuesday in district court.

He is being held in the Ward County Jail. Jhonson’s next court date is his preliminary hearing for the new charges, scheduled for Dec. 14.
