Moody given deferred sentence for damaging payloader

Tyler James Moody, 31, Minot, pleaded guilty on Jan. 20 in district court in Ward County to Class B felony criminal mischief. Moody was originally charged along with Curtis Schmitz with firing multiple shots with .22-caliber rifles on May 31, 2020, at a Caterpillar payloader belonging to a sand and gravel company in Minot that caused more than $50,000 in damages.

Judge Gary Lee deferred imposition of Moody’s sentence, ordering two years of supervised probation, and that he must have no contact with Sundre Sand & Gravel. Moody was also assessed $125 in court fines and fees. Moody and Schmitz were both ordered to pay $53,740.62 in restitution for damaging the payloader.
