Berryhill pleads guilty to intent to deliver

Shawn Joseph Berryhill, 33, Minot, had pleaded guilty to two Class B felonies for possession with intent to deliver methamphetamine and fentanyl, and a Class C felony for unlawful possession of drug paraphernalia.

Berryhill made his plea in district court in Minot on Jan. 24 before Judge Richard Hagar on charges originating from late December 2021, when investigators discovered about 4.5 grams of meth and 3.9 grams of fentanyl at a residence where Berryhill admitted he was staying. Investigators noted in their affidavit filed with the court that the supply of drugs and the packaging involved was more than would be expected for a typical user of illegal drugs, and that messages on Berryhill’s phone indicated he had been selling narcotics.

Hagar sentenced Berryhill to a concurrent sentence across the three counts: 10 years in the Department of Corrections and Rehabilitation, with all but three years suspended and credit for 154 days already served. Upon release Berryhill will be required to complete three years of supervised probation and a chemical dependency evaluation. Berryhill also was assessed $775 in court fines and fees.
