Murder defendant thinks his bond is unconstitutional

Rape and murder defendant Shawnee Lynn Krall called his amended bond of $200,000 cash or corporate surety unconstitutional and said she should release him on his own recognizance in a letter to Judge Stacy Louser last month.

“Also, I’m indigent so I’m requesting a PR bond as well because the punitive bond and the fees for ankle monitoring amount to a debtor’s prison,” wrote Krall in a letter filed with the court. “With all that being said, the current amended bail order is unconstitutional and should be changed immediately … Requiring an indigent defendant to post punitive bail for pre-trial release violates the equal protection clause and the due process clause of the 14th Amendment of the United States Constitution.”

Louser agreed to lower Krall’s bond from $2 million to $200,000 last month but ordered that he must wear an ankle monitor and be drug tested twice a week if he is released. Krall refused to sign the bond order after Louser lowered the bond.

In an order on bond on June 20, Louser said Krall will have to sign the amended bond order and a waiver of extradition before he can be released on bond. She said in the filing that his refusal to comply with the court order causes “serious concern” regarding how willing he will be to abide by the other conditions of the bond order.
