Attempted murder trial ends in mistrial
An attempted murder re-trial for Travis Eugene Yoney, 48, of Minot, ended in mistrial on Wednesday, according to Ward County State’s Attorney Roza Larson.
No cause was immediately given for the mistrial.
Judge Gary Lee issued an order for Yoney on Wednesday to be transported back to the North Dakota State Penitentiary.
No new trial date has yet been scheduled.
Yoney was convicted at trial in 2019 of attempted murder and sentenced to prison, but the state Supreme Court ordered that he receive a new trial because a state Supreme Court ruling in another, unrelated case with a different defendant also called into question how the attempted murder charge was explained to the jury in the Yoney case.
Yoney allegedly tried to kill a confidential informant in 2018, whom he blamed for his conviction for dealing marijuana. On Tuesday, during opening arguments, his defense attorney had called into question the motives of the alleged victim in the case. Yoney has denied he went over to the other man’s residence with the intent to kill him.
