Phelix Rush-Klevgaard, Courtney Berry charged with exposing baby to drugs, filthy house
Phelix Roy Rush-Klevgaard, 30, and Courtney Alexandria Berry, 28, Minot, are charged in district court in Minot with exposing a baby to illegal narcotics and a filthy house on Tuesday.
Both are charged with Class C felony child endangerment, Class C felony possession of methamphetamine while in possession of a firearm, Class C felony possession of drug paraphernalia, Class A misdemeanor possession of marijuana paraphernalia and possession of marijuana, an infraction. Rush-Klevgaard is also charged with Class A misdemeanor obstruction. Berry, who told authorities she is three months pregnant, had admitted to using meth the day before.
According to a probable cause affidavit filed with the court, Ward County deputies had gone to the residence to serve Rush-Klevgaard and Berry with an eviction notice and had to break down the door with a sledge hammer when Rush-Klevgaard tried to prevent them from opening the door. The house was filled with trash, according to the affidavit. There was a rifle in the bedroom along with several meth pipes and a plastic container containing suspected meth.
The baby was released to the custody of a friend of Berry’s.
