Joshua Lochthowe, Minot, sentenced to 76 days time served, probation, for assaulting deputy, resisting arrest, reckless driving

Joshua Ryan Lochthowe, 27, Minot, was sentenced on Monday to 360 days in jail, all suspended but the 76 days he has already served in the Ward County Jail. He got 11 days off his sentence for good behavior, and two years of supervised probation.

Lochthowe assaulted a Ward County deputy while resisting arrest after he was stopped on Dec. 27, 2019. He fled, speeding away with the deputy’s body camera still in his pickup.

Judge Gary Lee also ordered Lochthowe to complete high intensity outpatient treatment for alcohol addiction, to participate in the 24/7 Sobriety Program that requires daily testing for the next six months, and to not use any alcohol while he is on probation. Lochthowe must also pay $1,034.16 in restitution to the deputy he injured for medical expenses as well as court costs.

He received concurrent sentences for Class C felony assault on a peace officer, Class C felony resisting arrest, Class A misdemeanor fleeing a police officer in a motor vehicle, and Class B misdemeanor reckless driving. He was found guilty of all of the offenses at trial in September. A jury acquitted him of Class B misdemeanor DUI.

If Lochthowe successfully completes probation, the felony charges will be reduced to Class A misdemeanors on his record.

Lochthowe apologized for his actions in court during the sentencing hearing.

Ward County Assistant State’s Attorney Tiffany Sorgen and defense attorney Kyle Craig both told the judge that Lochthowe’s behavior is strongly influenced by years of alcohol addiction. Sorgen said she hopes that Lochthowe will “turn it around” and take advantage of treatment programs while he is on probation.

Lochthowe was sentenced last month to 360 days in jail, all suspended, and two years of supervised probation for tampering with the deputy’s body camera on Dec. 27, 2019, a separate Class C felony. The body camera was located and turned in to the jail after the incident. When deputies reviewed the footage, it showed Lochthowe speeding away, then getting stuck at a gravel pit. Lochthowe had tried to turn off the camera but instead he turned it off and then on again. He can be heard leaving the vehicle and then throwing the camera through the air. The body camera was not damaged.
