Cody Berdahl, Minot, sentenced to 110 days time served, 18 months supervised probation, for kicking police officer in the chest

Cody Allan Berdahl, 23, Minot, was sentenced on Thursday to 360 days in the Ward County Jail, all suspended but the 110 days he has already served, and 18 months supervised probation for kicking Minot police officer Thomas Lynn in the chest on June 7. He received a deferred imposition of sentence on a charge of Class A misdemeanor criminal mischief for destroying Lynn’s body camera, which was valued at $800, during the assault. The state agreed to dismiss a Class A misdeemanor charge of resisting arrest.

Berdahl was also ordered to pay $825 in court costs. Restitution for the body camera was reserved for 90 days.

If Berdahl successfully completes probation, the felony charge will be reduced to a Class A misdemeanor.

According to a probable cause affidavit filed with the court, police had been asked to do a welfare check on Berdahl, who had been spotted laying in a yard in southeast Minot. When police responded, Berdahl appeared to be under the influence of something and assaulted Lynn when he was placed under arrest on outstanding warrants. Lynn was injured during the assault and sought treatment at the Trinity Hospital emergency room.
