State files new charge against Brent Castleman after he was acquitted of stalking woman
The Ward County State’s Attorney’s Office filed a new Class A misdemeanor violation of a judicial order charge against Brent Allen Castleman, 52, Minot, not long after a jury acquitted him earlier this month of stalking the same alleged victim.
Castleman made an appearance on the new charge in court on Wednesday before Judge Todd Cresap, who questioned the state’s credibility in bringing the new charge.
Castleman’s defense attorney, Kyle Craig, noted that the state has brought charges against Castleman so far on three separate occasions in cases involving the same alleged victim and Castleman has been acquitted each time. The latest allegation is that Castleman and the woman had contact at a busy intersection on May 29. Craig said the allegation was immediately reported to police but the prosecution appears to have “just sat on” the charge until after Castleman was acquitted of the stalking charge on July 2.
This is just the latest charge that has been brought against Castleman in what Judge Cresap said is a domestic dispute that has been dragged into the criminal system. The prosecution acknowledged Wednesday there has been a “long and tortured history” between Castleman and the alleged victim. Most of the charges against Castleman have involved allegations made by his ex-wife.
All of the judges in the North Central Judicial District have recused themselves from hearing other cases against Castleman and most of those cases were assigned to judges outside the jurisdiction. Cresap said he has recused himself in the past because he knows Castleman, but Castleman agreed to let Cresap set bond on the new charge on Wednesday.
The prosecution had asked for bond to be set at 10 percent of $7,500 but Cresap set a $2,500 unsecured appearance bond, meaning Castleman doesn’t need to post any money to get out of jail but will owe the $2,500 if he fails to make his court appearances.
In another case, a jury trial is scheduled for Sept. 28 before Northeast District Court Judge Michael Hurly on some child abuse charges against Castleman. Hurly had earlier dismissed some of the child abuse charges against Castleman because they were connected to an assault of which Castleman was previously acquitted. Castleman was alleged to have assaulted the woman in front of a child or children and had been acquitted by a jury of assaulting the woman.
In an unrelated case, a jury trial is scheduled for Nov. 8 before Northwest District Court Judge Kirsten Sjue on charges that Castleman kicked a police officer in the groin and in the knee while he was resisting arrest on Feb. 28.
