Angelia Moton, Minot, charged with child endangerment

Angelia Deon Moton, 20, Minot, is accused of endangering her 11-month-old daughter, who ingested methamphetamine, amphetamines, cocaine, marijuana and other drugs earlier this month, according to a probable cause affidavit filed with the court. Moton is charged in district court in Minot with Class C felony child endangerment.

She made an initial appearance in court on Monday before Judge Gary Lee, who set bond at 10 percent of $5,000 and ordered Moton to have no contact with her daughter except as allowed by Ward County Social Services. The baby is in foster care. A preliminary hearing date is scheduled for Oct. 1.

According to the affidavit, Moton brought the child to Trinity Hospital on July 9 and reported that the baby had been losing consciousness and was not acting like herself. The baby could not stay awake in the presence of medical personnel and her head would fall down suddenly. Moton denied that the baby had ingested any foreign substances or that she had been exposed to narcotics. The hospital ran a urine drug screen on the baby and it tested positive for cocaine and marijuana. Authorities also ran a hair follicle test on the baby and she tested positive for amphetamine, methamphetamines, cocaine, benzolyecogonine, hydroxycocaine, and marijuana. The lab reported that the tests are ingestion based, not exposure based.

Moton told authorities she and the baby had been at her daughter’s father’s residence on July 8 and then returned home the following day. She was not sure what the baby had gotten into. Police seized her phone as part of a probation search and noted on ongoing text message conversation between Moton and her daughter’s father regarding drug use and with whom Social Services would place the baby. The father of Moton’s daughter advised her to watch what she said because police might take her phone and told her to lock it. Moton responded in text message speak that she was already 10 steps ahead and told her daughter’s father that she had already beat four cases and she could beat another four.

Moton had previously pleaded guilty in April 2018 to Class C felony child neglect for exposing her then 1-year-old son to drugs in December 2017. Moton was the driver of a car that was pulled over at 1:05 a.m. on Dec. 15, 2017 in Minot. Moton had a meth pipe in the front pocket of her sweater. The boy was asleep on the rear passenger seat. A meth pipe was on the floor, directly under the baby boy. Judge Gary Lee initially gave her a deferred imposition of sentence for two years, meaning that the charge was to be dismissed in April 2020 if Moton fulfilled all the required conditions, but Lee revoked the sentence in November 2018 and sentenced her to the 31 days she had already served in jail and two years probation. She also received a concurrent sentence on a Class A misdemeanor charge of possession of drug paraphernalia.

In February 2019 Moton was sentenced to 360 days in jail, all suspended but the 63 days she had already served, and two years of supervised probation for fleeing from police at a high rate of speed through the Robinwood addition in a 2012 Mini Cooper that had been reported stolen on Sept. 9, 2018, and for being in possession of a loaded hypodermic syringe. The state dropped a Class B felony charge of possession of a stolen motor vehicle and a Class B misdemeanor reckless driving charge against Moton under the terms of the plea deal.
