Kala Russo, Minot, sentenced to time served, Drug Court probation for intent to deliver meth
Kala Nicole Russo, 33, Minot, was sentenced on Tuesday to one year in jail, all suspended but the 39 days she has already served, and two years of supervised probation through Adult Drug Court for Class B felony possession of methamphetamine with intent to deliver in January. She received a concurrent sentence on a Class A misdemeanor charge of Class A misdemeanor possession of drug paraphernalia.
Judge Gary Lee also ordered Russo to pay $775 in court costs.
According to a probable cause affidavit filed with the court, police had gone to Robindale Trailer Park on Jan. 6 to investigate another case. They saw Russo and a man walking in the playground area while they were at the trailer park. The man was arrested on outstanding warrants. While they were searching the man, the officer spotted Russo pull a pink pouch with a green zipper out of her brown backpack and throw it over a privacy fence next to her. An officer collected the pink pouch. Russo was also placed under arrest for an outstanding warrant in an unrelated case. An officer searched the pouch and found about 150 blue plastic baggies, including five baggies that contained about 2.1 grams of suspected methamphetamine. Also in the bag was a silver tool with a white crystalline substance on both ends.
Russo laughed in court on Tuesday when a prosecutor read a summary from the affidavit.
“Is something funny?” Lee asked her.
“No, it’s stupid,” said Russo, referring to her behavior.
She has been admitted to Drug Court, which Lee warned her is a rigorous program with intense supervision. Drug Court is treatment-oriented, supervised by the court, and is intended for non-violent offenders whose legal problems stem from substance abuse. Prosecutors have said it is a program that has had some successful graduates in past years who have succeeded in turning their lives around.
