Juan Riojas Hernandez sentenced to 30 days for driving into Minot house while drunk

Juan Manuel Riojas Hernandez, 27, Glen Ullin, was sentenced on Friday to a year in jail, with all time suspended but 30 days, followed by three years of supervised probation for crashing his pickup into a house in the 600 block of Eighth Street NW in Minot when he was drunk on May 19, 2019.

Riojas Hernandez pleaded guilty to Class C felony criminal mischief and Class B misdemeanor DUI.

Ward County State’s Attorney Roza Larson told Judge Doug Mattson that Riojas Hernandez had a blood alcohol content reading of .189, more than twice the legal limit, when he drove into the house.

Larson said the estimated damage done by Riojas Hernandez added up to $94,856.80.

Riojas Hernandez had been drinking with his girlfriend at a Minot bar before the incident and he believes that his drink was spiked with Lorazepam. He remembers little about the accident, according to statements made at the sentencing hearing. Both Riojas Hernandez and his girlfriend, who was a passenger in the pickup, were unconscious after the accident and were taken to Trinity Hospital for treatment of non life-threatening injuries. The house he drove into was unoccupied at the time.

Riojas Hernandez apologized at the sentencing hearing for what happened.

Judge Doug Mattson also ordered Riojas Hernandez to pay $525 in court costs and scheduled a restitution hearing for May.

Riojas Hernandez will receive credit for the week he already served at the Ward County Jail. He was taken into custody on Friday afternoon to serve the rest of his sentence.
