Matthew Mize, Minot, sentenced to three years for intent to deliver meth, felon in possession of firearm, fleeing police

Matthew Ford Mize, 36, Minot, was sentenced on Wednesday to 10 years in prison, with a requirement that he serve three years, and three years of supervised probation for Class A felony intent to deliver methamphetamine while in possession of a firearm in Minot on June 23, 2019. He was also sentenced to a flat three-year sentence on charges of Class C felony felon in possession of a firearm and Class C felony fleeing police.

The state agreed to dismiss other charges against Mize under the terms of a plea deal, including Class C felony possession of drug paraphernalia, Class C felony theft of property, Class A misdemeanor driving with a suspended driver’s license and Class B misdemeanor leaving the scene of an accident.

According to police and statements in court, police had investigated a reported robbery in progress at the Ranch Apartments in the 2800 block of East Burdick Expy. As officers were arriving on the scene, Mize fled on a stolen motorcycle and crashed into one of the patrol vehicles, causing minor damage. Mize continued to flee and then crashed into another vehicle at Eighth Street and West University Avenue. He then fled on foot and was caught by police. When they searched him, they found that he had a handgun in his waistband. He was also carrying a backpack that contained a digital scale with meth residue, a shaving cream container with a false bottom that concealed empty baggies, about 20.6 grams of methamphetamine and 4.7 grams of marijuana. Mize also had $240 on his person.

Judge Todd Cresap also ordered Mize to obtain a chemical dependency evaluation and to pay $1,600 in court costs.

Mize will receive credit for 214 days already served in the Ward County Jail. He will not get any time off for good behavior because he was written up for fighting while he was in jail.

Mize, who had a previous felony conviction, must also surrender the firearm to law enforcement and the money that was found on him when he was arrested.
