Ernesto Angel Rivas-Ortiz, 42, is charged with Class C felony corruption of a minor in district court in Minot for allegedly having sex with a girl when she was 16 and 17 in 2013 and 2014. Rivas-Ortiz would have been 36 at the time.

According to a probable cause affidavit filed with the court, the girl’s mother called police in July 2014 and reported that her 17-year-old daughter had been sneaking out and running off to see “Angel.” The girl told police that she had met “Angel” at a local restaurant in September 2013, when she was 16, and he asked her to go to the movies. About two weeks after they met, Rivas-Ortiz picked her up, took her to a motel, and they started having sex. The sexual relationship continued for a number of months. The girl didn’t tell Rivas-Ortiz how old she was until about four months after they met. The girl told police that Rivas-Ortiz assumed she was about 23 because of the way she looked.

Rivas-Ortiz later allegedly acknowledged in a phone call that he had had sex with the girl and knew her age.

The complaint was filed with the court on Aug. 4, 2015 but was not served on Rivas-Ortiz until Monday. Rivas-Ortiz was scheduled to make an initial appearance on the charge on Monday in district court before Judge Gary Lee.
