Jesse Fanning, Miller, S.D., accused of kicking Minot police officer while resisting arrest

Jesse Lee Fanning, 33, Miller, S.D., is accused of kicking an officer while resisting arrest in Minot on Friday.

Fanning is charged in district court with Class C felony simple assault on a police officer and Class A misdemeanor resisting arrest.

According to the probable cause affidavit filed with the court, police responded to a disturbance at the Sports on Tap Bar on South Broadway. Fanning had been screaming and walking around. Officers approached him and he screamed threats and profanities at the officers in the parking lot. Fanning then physically resisted when officers placed him under arrest and kicked Officer Anthony Hugg in the arm when they were placing him in a patrol vehicle. He also kicked another officer in the thigh, according to the affidavit.

Fanning was cleared at Trinity Hospital and then taken to the Ward County Jail, where he continued to threaten officers and had to be carried into his cell.

A preliminary hearing is scheduled in district court in Minot for Nov. 5 before North Central District Court Judge Doug Mattson.
