Maggie Albertson, Minot, sentenced for child neglect, assault on peace officer

Maggie Marie Albertson, 30, Minot, will serve 30 days in jail for being too intoxicated to care for her baby daughter on Nov. 23 and for kicking a police officer in the leg when she was arrested.

Albertson pleaded guilty on Tuesday in district court in Minot to Class C felony child neglect and to Class C felony simple assault on a police officer. The Ward County State’s Attorney’s Office agreed to dismiss a Class C felony criminal trespass charge and a second charge of Class C felony simple assault on a police officer under the terms of a plea deal.

Judge Todd Cresap gave Albertson a two year deferred imposition of sentence on the child neglect charge along with two years of supervised probation and ordered her to obtain a chemical dependency evaluation.

He sentenced her to a year in jail on the assault charge, with all suspended but the 30 days, and ordered her to pay $1,100 in court costs and restitution yet to be determined. She will be on supervised probation for two years.

Albertson will be allowed to serve the jail sentence on weekends because she has just started a new job and wants to continue working. Ward County Assistant State’s Attorney Christopher Nelson asked that she not serve during the weekends of the State Fair in July because the jail will need the extra beds during that time and anticipates that there might be more arrests during that time frame.

According to court documents, Albertson got drunk on Nov. 23, left her 5-month-old daughter unattended and went upstairs and barged into another apartment. She allegedly claimed she had paid for marijuana which the neighbors never delivered, but they denied this. A relative was called to watch the baby when Albertson was placed under arrest for child neglect. Albertson kicked one of the officers in the leg when she was arrested. They took her to the hospital to be checked out and Albertson allegedly reared back and struck the right side of another officer’s face with the back of her head while she was being searched.
