Judge orders pre-plea investigation for Victoria Harris in child neglect case

Judge Stacy Louser ordered a “pre-plea investigation” on Wednesday for Victoria Harris, 25, who is charged with leaving the 4- and 2-year-old children she was babysitting alone in a cold car for up to an hour on Jan. 23. Harris was inside a salon getting a wax at the time, according to a probable cause affidavit filed with the court.

Harris will remain free on $10,000 cash or corporate surety bond. The investigation requested by her lawyer, Ashley Gulke, will include a criminal record check, psychological evaluation and other background information. The children’s parents both attended a hearing on Wednesday and objected to Harris remaining free on bond, but she has not yet entered a plea and is still considered innocent until proven guilty. Ward County Assistant State’s Attorney Christopher Nelson said the state agreed that Harris should remain free on bond.

Louser questioned whether the investigator will conduct an investigation prior to the plea being entered, but Gulke said it would be allowed.

Louser set a status conference for July 16.

According to the affidavit, the two children were left locked in the car, which was not running. The salon would not allow children to be there during Harris’s appointment. Harris had allegedly lied and told an employee at the salon that a friend had picked up the children. Police received a report that the children had been left alone in the car and responded to the business, where they placed Harris under arrest.

The Class C felony child neglect charge carries a maximum sentence of five years in prison and a $10,000 fine.
