State files to dismiss charges against Chad Bruce; defense lawyer has questions

A prosecutor filed to dismiss charges against Chad Damon Bruce, 41, Minot, who is accused of fleeing from police through the Best Buy parking lot in Minot in June while in possession of a stolen firearm. However, it sounds like the charges could be refiled, which concerns Bruce’s lawyer, Andrew Schultz.

Ward County Assistant State’s Attorney Robert Vallie said in his motion that “there is a pending investigation, involving a victim, regarding actions of the defendant just prior to this incident that tie into these offenses. The State has been advised that the two incidents, occurring successively with each other, and may constitute parts of a common scheme or plan.”

“I don’t know what that means,” Schultz said in court on Thursday.

Schultz said a “global plea deal” involving these offenses and other pending charges against Bruce was about to be agreed to. Schultz asked whether the state plans to file new charges that would affect the plea agreement being worked out as well as a probation revocation hearing that is scheduled for Bruce. Judge Todd Cresap also told Vallie that the motion is too vague and ordered him to submit a brief explaining why he wants to dismiss the charges.

In this case, Bruce is charged with unlawful possession of a firearm by a felon, a Class C felony, possession of a stolen firearm, a Class C felony, and refusal to halt, a Class A misdemeanor.
