Men face charges following hotel room brawl

Two men are facing multiple charges following a dispute at the Souris River Hotel on Saturday morning.

Nicholas Afton Youngbird is charged with aggravated assault for allegedly stabbing his friend in the neck during the fight. His friend, Garrett Shawn Smith, 25, of Halliday, is charged with Class C felony aggravated assault, spitting at a police officer, and resisting arrest, all Class C felonies. Each Class C felony carries a maximum sentence of five years in prison and a $10,000 fine. They were both scheduled to make an initial appearance in district court in Minot on Monday.

According to a probable cause affidavit filed with the court, Smith told police that he and Youngbird had been drinking and had a dispute over a sore topic. Youngbird grabbed a knife, Smith told Youngbird to stab him and Youngbird then stabbed him. Smith then grabbed the back of Youngbird’s head and head-butted Youngbird.

Smith and Youngbird were taken to the hospital for injuries. Youngbird had several broken bones in his face. Smith had two puncture wounds on the neck and a few on his shoulder.

Smith spat at an officer twice while they were walking him into the emergency room and tried to chest bump him. He became aggressive and the officers forced him to the ground. He turned his head and spat at the officer again, hitting him with blood, mucus and saliva. Smith had to be sedated.
