Generally, the Work covered by the
Plans and Specifications for the
Lead Service Determination project
will consist of the materials, labor,
tools, and equipment required to
verify and document the pipe
material of 73 service lines by
hydrovac excavation within 2′ on
each side of the existing curb stops.
All work shall conform to AWWA
C810-17 Replacement and Flushing
of Lead Service Lines Standard. All
excavation will be backfilled as indicated
on drawings and specification.
The work shall have a final
completion date of July 1, 2022.
All Bids are to be submitted on the
basis of cash payment for the Work
and Materials necessary to complete
the project. Each bid must be accompanied
by a separate envelope
containing the contractor’ s license
and bid security. The bid security
must be in a sum equal to five percent
of the full amount of the bid and
must be in the form of a bidder’ s
bond. A bidder’ s bond must be executed
by the bidder as principal and
by a surety, conditioned that if the
principal’ s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond
and any condition of the governing
body. A countersignature of a bid
bond is not required under this section.
If a successful bidder does not
execute a contract within the ten
days allowed, the bidder’ s bond
must be forfeited to the Owner and
the project awarded to the next
lowest responsible bidder. Bidders
must be licensed for the full amount
of the bid as required by section
43-07-12 of the North Dakota Century
Code.
Bidders on this work will be required
to comply with Title 40 CFR Part 33-
Participation by Disadvantaged
Business Enterprises in the United
States Environmental Protection
Agency Programs. The requirements
for bidders and contractors
under this regulation concern utilization
of Minority Business Enterprises
(MBE), Women’ s Business Enterprises
(WBE), and Small Business
Enterprises (SBE) and are explained
in the specifications.
The goal for MBE is 2% of the total
dollar value of the project. The goal
for WBE is 3% of the total dollar
value of the project.
Bidders shall demonstrate a good
faith effort to solicit for MBE and
WBE subcontractors. The completed
MBE/WBE Solicitation Information
sheet must be provided in the outer
bid security envelope. Failure to
include this information will result in
the bid not being opened. No Bid
may be read or considered if it does
not fully comply with the requirements
of Section 48-01.2-05 of the
North Dakota Century Code.
Bidders on this work will be required
to comply with the President’ s
Executive Order No. 11246, as
amended.
The requirements for bidders and
contractors under this order are explained
in the specifications.
The Owner reserves the right to hold
all Bids for 45 days, to reject any or
all Bids, to waive any informality
or irregularity in any Bid, to accept
the Bid deemed in the best interest
of the Owner, and to rebid the
project until a satisfactory bid is
received.
There shall be endorsed upon the
outside of the envelope containing
the Bid, the following:
1. “City of Flaxton, North Dakota,
Lead Service Line Determination”
2. The name of the person, firm, corporation,
or joint venture submitting
the Bid.
3. The Bidder’ s Contractor’ s
L i c e n s e
or Contractor’ s License Renewal
Number.
4. Acknowledgement of the
Addenda, if any.
Any deficient Bid received will be
resealed and returned to the Bidder
immediately.
All work shall be substantially complete
by June 15, 2022. All work
shall be completed and ready for final
payment in accordance with the
General Conditions within 60
calendar days of the substantial
completion dates.
Should the Contractor fail to complete
its obligations under the Contract
within the time required herein
or within such extra time as may
have been granted by formal extensions
of time approved by the Owner,
there will be deducted from any
amount due to the Contractor the
sum of $500 per day for each and
every calendar day that the completion
of the Work is delayed. The
Contractor and his Surety will be
liable for any excess. Such payment
will be as and for liquidated
damages and not as a penalty.

In general, the Work included in the
Project includes the labor, materials,
tools, and equipment required to
construct MREFPP Phase WC-1B
Tierrecita Vallejo as fully depicted in
the Drawings and Technical Specifications
for the Project. The project is
located within Ward County, North
Dakota.
All Bids are to be submitted on the
basis of cash payment for the Work,
and are to be enclosed in a sealed
envelope addressed to the undersigned
Chairman, endorsed as required
below. Each bid must be accompanied
by a separate envelope
containing the contractor’ s license
and bid security. The bid security
must be in a sum equal to five percent

Bid and must be in the form of a

amount due to the Contractor the
sum of $5,000.00 per day (with no
suspension for winter work) for each
and every calendar day that the substantial
or final completion of the
Work is delayed. The Contractor and

Such payment will be as and
for liquidated damages and not as a
penalty.
