NOTICE IS HEREBY GIVEN that
the City of Minot (Owner) is re-
questing Bids for the construction of
the following Project: 2021 Nuisance
Abatement
Bids for the construction of the Pro-
ject will be received at the office of
the City Clerk located at 515 Second
Avenue SW (Second Floor), Minot,
North Dakota 58701, until Tuesday,
June 1, 2021 at 11:00am local time.
At that time the Bids received will be
publicly opened and read.
The Project includes the following
Work: Inert Debris Removal per
TON, Individual Landfill Items per
EA, and other associated items.

Each bid must be accompanied by a
separate envelope containing the
bid security in a sum equal to five
percent of the full amount of the bid
and must be in the form of a bidder’s
bond. A bidder’s bond must be exe-
cuted by the bidder as principal and
by a surety, conditioned that if the
principal’s bid is accepted and the
contract awarded to the principal,
the principal, within ten days after
notice of the award, shall execute a
contract in accordance with the
terms of the bid and the bid bond,
and any condition of the City of
Minot, as required by law. A counter-
signature of a bid bond is not re-
quired. If the City of Minot elects to
award a contract to the lowest
responsible bidder, and the lowest
responsible bidder does not execute
a contract within the ten days al-
lowed, the bidder’s bond must be
forfeited to the City of Minot and the
project awarded to the next lowest
responsible bidder.
Each bidder must possess a valid
North Dakota contractor’s license for
the full amount of their bid, as re-
quired by Section 43-07-07 of the
North Dakota Century Code. Each
bidder MUST enclose a copy of their
Contractor’s License or Certificate of
Renewal, issued by the North Dako-
ta Secretary of State, in their bid
bond envelope, and each license
must be valid and dated at least 10
days prior to the date set for bid
opening, as required under Section
43-07-12 of the North Dakota Centu-
ry Code.
No bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of
the North Dakota Century Code, and
any deficient bid submitted will be
resealed and returned to the bidder
immediately.
All Bids submitted and all Work
completed must be as stipulated in
the Contract.
The City of Minot reserves the right
to hold all Bids for a period of 30
days after the date of the bid open-
ing, to reject any or all Bids and to
rebid the project until a satisfactory
bid is received, and to waive any in-
formality or irregularity in any Bid.

Each bid must be accompanied by a

¯Reinstallation of two outdoor
basketball hoop and backboard as-
semblies onto new foundations,
reinstallation of 100 LF of 8-foot tall
vinyl-covered chain link fence and
direct-driven fence posts.
¯214 LF of new vinyl-coated 4′ tall
sports court fencing with
direct-driven posts, and (1) 3′-0″
wide access gate with gate
hardware.
¯11,360 SF of sports court surfac-
ing, and 1,140 LF of acrylic paint
playing surface markings of
various colors.
¯Miscellaneous and ancillary gen-
eral construction including but not
limited to daily and project clean up,
erosion and dust control, City of
Minot permits, topsoil and grass res-
toration.
¯New LED lighting and related
electrical construction; all of which is
included in the Single Prime lump
sum bid.
¯All other Work indicated on the
plans and specifications. All Bids are
to be submitted on the basis of cash
payment for the Work and Materials,
and proposed start and completion
dates, which are to be enclosed in a
sealed envelope addressed to the
undersigned
Minot Park District, accompanied by
a separate envelope containing a
Bidder’s Bond in the sum equal to
5% of the full amount of the Bid, ex-
ecuted by the Bidder as Principal,
and by a Surety, conditioned that if
the Principal’s Bid is accepted and
the contract awarded to the Princi-
pal, the Principal, within ten days
after notice of award, shall execute a
Contract in accordance with the
terms of the Bid and Performance
and Payment Bonds as required by
the law and the regulation and deter-
minations of the Owner’s counsel.
Countersignature of a Bid Bond is
not required. Bidders shall be
licensed for the full amount of the
Bid, as required by Section 43-07-05
of the North Dakota Century Code.
No Bid may be read or considered if
it does not fully comply with the re-
quirements of Section 48-01.2-05 of
the North Dakota Century Code. Any
deficient Bid received will be
resealed and returned to the Bidder
immediately. The Owner intends to
immediately award the project
should bid costs and proposed
schedules fall within their
pre-approved budget; however,
Owner reserves the right to hold all
Bids for 30 days, to reject any or all
Bids and to waive any informality or
irregularity in any Bid. A copy of the
Bidder’s Contractor’s License or
License Renewal must be included
in the Bid Bond envelope. If a suc-
cessful bidder does not execute a
contract within the ten days allowed,
the bidder’s bond must be forfeited
to the governing body and the pro-
ject awarded to the next lowest
responsible bidder. There shall be
endorsed upon the outside of the en-
velope containing the Bid, the follow-
ing:
1. “Riverside Sports Court 2021 Im-
provements”
2. The name of the person, firm, cor-
poration, or joint venture submitting
the Bid.
3. Acknowledgement of the Adden-
da.
All work shall be substantially com-
plete by September 17, 2021. All
work shall be completed and ready
for final payment in accordance with
the General Conditions by Sep-
tember 30, 2021. Contractor and
Owner recognize that time is of the
essence of the Agreement and that
the Owner will suffer beneficial loss
if the Work is not completed within
the times specified above, plus any
extensions thereof allowed in accor-
dance with Article 11 of the General

In general, the Work included in the
Project includes the labor, materials,
tools, and equipment required to
construct MREFPP Phase WC1A
Tierrecita Vallejo as fully depicted in
the Drawings and Technical Specifi-
cations for the Project. The project is
located within Ward County, North
Dakota.
All Bids are to be submitted on the
basis of cash payment for the Work,
and are to be enclosed in a sealed
envelope addressed to the under-
signed Chairman, endorsed as re-
quired below. Each bid must be ac-
companied by a separate envelope
containing the contractor’s license
and bid security. The bid security
must be in a sum equal to five per-

The Work shall be substantially
complete by September 30, 2022.
All Work shall be complete and
ready for final payment in accor-

Should the Contractor fail to com-
plete its obligations under the Con-
tract within the time required herein
or within such extra time as may
have been granted by formal exten-
sions of time approved by the Own-
er, there will be deducted from any
amount due to the Contractor the
sum of $5,000.00 per day (with no
suspension for winter work) for each
and every calendar day that the sub-
stantial or final completion of the
Work is delayed. The Contractor and
his Surety will be liable for any ex-
cess. Such payment will be as and
for liquidated damages and not as a
penalty.

April 20, 2021
The regular meeting of the Ward
County Commission was called to
order by Chairman Fjeldahl at 9:00
AM with Commissioners, Anderson,
Pietsch, Rostad, and Weppler
present. Also present were depart-
ment heads Bradley Starnes, Dana
Larsen, Emily Goff, Jason Blowers,
Jennifer Wiechmann, Kristin
Kowalczyk, Marisa Haman, Melissa
Bliss, Noreen Barton, Robert Roed,
Roza Larson and Tammy Terras.
Moved by Comm. Rostad, seconded
by Comm. Weppler to approve the
agenda. Roll call; all voted yes; mo-
tion carried.
Moved by Comm. Rostad, seconded
by Comm. Weppler to approve
Commission meeting minutes from
April 6, 2021. Roll call; all voted yes;
motion carried.
Moved by Comm. Anderson,

State’s Attorney Roza Larson
presented Karen Pfeifer a 10 Years
of Service Ward County Centennial
coin.
Human Service Zone Director Melis-
sa Bliss presented Connie Zieske
with a Ward County Centennial gold
coin. Ms. Zieske was recognized for
her 38 years and 10 months of ser-
vice at the Ward County Human
Service Zone. Ms. Zieske will be re-
tiring April 30, 2021.
Scott Wegner of Arntson Stewart
Wenger appeared along with Roger
Mazurek from the YMCA. They re-
quested to hold a public hearing dur-
ing the May 18, 2021 Commission
meeting to request the Commission
sponsor refinancing of the YMCA’s
MIDA Bonds.
Moved by Comm. Weppler, second-
ed by Comm. Rostad to approve the
request and hold a public hearing re-
garding the MIDA Bonds during the
May 18, 2021 Commission meeting.

State’s Attorney Roza Larson ap-
peared and informed the Commis-
sion sales of tax foreclosed proper-
ties cannot be sold for less the
minimum sale price set for the No-
vember tax sale even if a realtor is
used. She further stated the County
cannot negotiate the terms of the
sale.
Michael Pankow appeared regarding
a tax foreclosed property he would
like to purchase for less than the
minimum sale price due to the poor
condition of the property as well as
legal fees required to obtain a clear
title of property. It was stated that
any agreements made for less than
the minimum sale price are null and
void.

ed by Seconded by Comm. Pietsch
to open the public hearing at 9:30
AM regarding the moving permit ap-
plication for Aaron Ottmar. Roll call;
all voted yes; motion carried.
Mr. Ottmar is requesting to move a
double garage from the City of Minot
to Logan.
No one from the public came for-
ward for or against the moving per-
mit.

public hearing at 9:31 AM. Roll call;

Building Inspector Leo Schmidt
recommended approving the moving
permit.
Moved by Comm. Weppler, second-

the moving permit for Aaron Ottmar
as presented. Roll call; all voted yes;
motion carried.
IT Director Jason Blowers appeared
requesting two commissioners to be
part of a committee to redesign the
County Website. Commissioners
Rostad and Weppler volunteered for
the Committee.
Highway Engineer Dana Larsen in-
formed the Commission interviews
were held April 13, 2021 to select an
engineering firm to complete the SW
and SE Connector Corridor Study.
Three firms submitted proposals and
the recommendation is to select Bol-
ton and to complete the study. The
study is to be completed April 30,
2022 and has a budget of $250,000
with an 80/20 split with the Federal
Highway Administration.

ed by Comm. Anderson to approve
the recommendation and select Bol-
ton and Menk to complete the SW
and SE Connector Corridor study
and authorize the Chairman to sign
the engineering contract. Roll call;
all voted yes; motion carried.
Doug Diedrichsen, Planning and
Zoning Administrator appeared re-
garding a Right of Way vacation re-
quest from Robert Pritchett that was
tabled during the April 6, 2021 meet-
ing.
Moved by Comm. Weppler, second-
ed by Comm. Rostad to remove
from the table the Right of Way va-
cation request from Robert Pritchett.
Roll call; all voted yes, except Com-
missioners Anderson and Fjeldahl
who voted no; motion carried.

Right of Way vacation request from
Robert Pritchett.
Discussion was held. Comm.

and recommend Mr. Diedrichsen
work with the surveyor and Mr.
Pritchett to create a new subdivision
plat that extends the ROW from the
county road that exists to the statu-

Human Resource Director Tammy
Terras congratulated five County
employees who attended and gra-
duated from the NACO High Perfor-
mance Leadership Academy. Justin
Vollmer, Kristin Kowalczyk, Bradley
Starnes, Leona Lochthowe and
Dana Larsen each presented what
they learned during the 12-week
academy to the Commission. The
Commission then presented each
employee with their graduation ma-
terials.
Ms. Terras continued with a draft of
the Commission Board Appointment
Policy and Board/Commission appli-
cation.

The Commission was given options
regarding the continuation of the
Families First Coronavirus
Response Act Policy which expired
on March 31, 2021.

and adopt the updated policy with
amendments per American Rescue
Plan Act April 1, 2021 until Sep-
tember 30, 2021 and apply for tax
credits available. Roll call; all voted
yes, except Comm. Pietsch.
Ms. Terras then presented the Com-
mission with an update regarding
the Compensation Study and two
components of the Compensation
study survey instrument which are
the recommended participant list
and benefits packages survey.

recommended participant list and
potential consideration organizations
from the participant list presented.

ship Board Action was called to ord-

present. Also present were depart-
ment heads Jason Blowers, Kristin

Board February 2, 2021
The Ward County Park Board meet-
ing was called to order by Chairman
Bachmeier at 8:00 AM with Commis-
sioners Rostad, Anderson, Weppler,
Fjeldahl and Pietsch present. Also
present were Highway Engineer
Dana Larsen, Assistant Engineer
Travis Schmit and Assistant Road
Foreman Les Malnaa.
The floor was opened for nomina-
tions for Chairman. Comm. Rostad,
seconded by Comm. Anderson
nominated Mr. Bachmeier for Chair-
man and Comm. Weppler for Vice
Chairman. With no other nomina-
tions the board casted a unanimous
ballot for Mr. Bachmeier as Chair-
man and Comm. Weppler for Vice
Chairman.
Moved by Comm. Fjeldahl, second-
ed by Comm. Weppler to approve
the meeting minutes from November
17, 2020. All voted aye; motion car-
ried.
Moved by Comm. Fjeldahl, second-

regular park bills totaling $7,998.13.
Motion was withdrawn and tabled
until the May meeting to give the
Board time to receive and review the
list of the bills.
Assistant County Engineer, Travis
Schmit appeared and began the dis-
cussion regarding the listing for the 5
County owned lots located at Rice
Lake for sale with the contracted
County Realtor. Century 21 has
been contracted to list and sell the
foreclosed properties now owned by
Ward County. The contract can be
amended to add the 5 Rice Lake
Lots. Tax Equalization has
reassessed the market value of
these lots. It was determined lake
front property is being assessed at
$4.75/Sq. Ft. and back lots at
$3.00/Sq. Ft. The suggested sale
price of these lots for 2021 was
determined based on $3.00/Sq. Ft.
The sale prices range from
$77,000.00 to $83,000.00.

recommending an amendment to
the contract with Century 21 to list
the five lots the County has for sale
at Rice Lake with the 2021 suggest-
ed prices. All voted aye; motion car-
ried.
Ward County survey crew took shots
of the swim beach at Rice Lake.
Staff is developing options to help
improve the use of the swim beach
at Rice Lake and make it more ac-
cessible for visitors. Some of the
goals of the redesign include: create
more usable space on the beach;
improve access form parking to
beach front; improve current parking
to better use the space and create
an aesthetic appearance of the swim
beach.
The final item the board needs to
consider is lighting options for Nel-
son Carlson Lake. Lighting options
from Verendrye are either a $3,000
onetime fee for supplying power (in-
stallation of transformer) or to enter
into a 10-year contract and pay a
$200 onetime fee. If the board
chooses to install receptacles at this
location, an electrician would need
to be hired to install any additional
items at County cost. The monthly
service fee is $39.50. Verendrye will
install light poles with an installation
fee of $500 per light pole. Each light
would have a $7.00 monthly charge
for lease of light/pole. If the board
were to utilize the 10-year contracts
an upfront cost of the $200.00 one-
time fee plus the $500.00 per light
pole. If three light poles were in-
stalled the monthly fee would be
$7.00 per pole for a total cost of
$21.00 per month plus the service
fee of $39.50 for a total monthly fee
of $60.50.
Verendrye options for service at
Bostau Lake (a.k.a. South Carlson
Lake) are either a $7,000 onetime
fee for supplying power (installation
of transformer) or to enter into a
10-year contract and pay a $4,000
onetime fee. Again if the Board
chooses to install receptacles at this
location an electrician would need to
be hired to install any additional
items at County cost. The monthly
service fee is $39.50.
