Sealed bids for Deaerator Replace-
ment, Bldg. 6850, Camp Gilbert C.
Grafton, Devils Lake, North Dakota
will be received by the Adjutant Gen-
eral of the State of North Dakota at
Fraine Barracks, Building 30,
Bismarck, North Dakota, until 2:00
PM, April 29, 2021, and will be pub-
licly read that date and hour in the
location designated. All bids re-
ceived after the scheduled opening
time will be returned to the bidders
unopened. The deadline for receipt
of technical questions is no later
than April 22, 2021.
Electronic bidding documents may
be requested. Emails must be ac-
companied by a copy of your current
North Dakota Contractor’s License
or Certificate of Renewal and your
request must be written on business
letterhead. No requests will be ack-
nowledged without receipt of both
documents. Submit request to
ng.nd.ndarng.list.dfe-contract-mana
gement@mail.mil.
Due to COVID 19, the bid opening
will not be open to the public. The
front gate entrance to Fraine Bar-
racks is closed to the general public.
A representative from the Facilities
Engineering Division will be at the
gate from 12:00 p.m. until 1:30 p.m.
CST on April 29, 2021. Bidders may
hand deliver their bids during that
time ONLY. Delivery by courier ser-
vice or U.S. Mail are the preferred
methods for delivery.
Modifications to bids are allowed in
accordance with the instructions in
AGND Document 411, Subpara-
graph 4.4.2. Bid modifications must
be received no later than 2:00 p.m.
CST. Be advised, the receipt of
emails and faxed transmissions
have a delay time due to data secu-
rity restrictions and military firewalls.
Allow adequate time for emailed and
faxed transmissions to travel
through our security system. The
OWNER is not responsible for bid
modifications that arrive later than
2:00 p.m. CST on the day of the bid
opening. Emailed bid modifications

Copies of the bidding documents are
on file at the Construction Plans Ex-
change in Bismarck; Builders Ex-
changes in Dickinson, Fargo, Grand
Forks, Mandan, Minot, Rapid City,
Impact Procurement Technical As-
sistance Center in Fargo, North
Dakota and Minnesota Builders Ex-
change in Minneapolis, Minnesota.
Each bid shall be submitted in dupli-
cate using the bid response forms
provided by the Owner, enclosed in
a sealed opaque envelope and la-
beled with the necessary information
as required by the Supplementary
Instructions to Bidders.
Each bid shall be accompanied by a
separate sealed opaque envelope
containing a bidder’s bond made
payable to The Adjutant General,
State of North Dakota, and executed
by the bidder as principle and by a
surety company authorized to con-
duct business in North Dakota, in a
sum equal to five percent (5%) of
the bidder’s highest total bid combi-
nation, including all add alternates to
the bid items; conditioned that if the
bid is accepted and the contract
awarded, the bidder within ten (10)
days after notice of such award, will
effect and execute a contract in ac-
cordance with the terms of his bid
and provide payment and perfor-
mance bonds as required by law
and the regulations and determina-
tions of the Owner. AIA Document
A310, Bid Bond, is provided in the
electronic project manual and should
be used to execute the bid guaran-
tee.
In compliance with Section 43-07-12
of the North Dakota Century Code,
each contractor submitting a bid
must have a copy of their North
Dakota Contractor’s License or certi-
ficate of renewal issued by the
Secretary of State enclosed in the
bid bond envelope; must be licensed
for the highest amount of their total
bid combination including add alter-
nates; and such license must have
been in effect at least ten (10) days
prior to the date of the bid opening.
No bid will be read or considered
which does not fully comply with the
provisions herein as to bid bond and
contractor license, and any deficient
bid submitted will be resealed and
returned to the bidder immediately.
The Owner reserves the right to hold
all legitimate bids for a period of thir-
ty (30) days following the date fixed
for the bid opening. It is the intent of
the Owner to award a contract to the
lowest and best bidder. The Owner
further reserves the right to reject
any and all bids and to waive irregu-
larities, and shall incur no legal liabil-
ity for the State for the payment of
any monies until the contract is
awarded and approved by the prop-
er authorities.
In compliance with Section
48-01.2-10 of the North Dakota Cen-
tury Code, the successful bidder
shall be required to furnish payment
and performance bonds covering the
faithful performance of the Contract
and the payment of all obligations
thereunder, and all additional obliga-
tions required by the laws of the
State of North Dakota. Each bond
shall be in an amount equal to the
full contract sum.

Mayor Tollefson called the meeting
to order with topic of agenda being
to hear police matters. Chief Howe
announced the department receiving
a grant from the Leona & Harr
Helmsley Charitable Trust for 3 defi-
brillators for the patrol cars. The
AED’s currently in the patrol units
would be distributed to the public
works, the office, and the community
room.
Bids for the new vehicle were:
Nelson Auto $36,616.14 (6 cyl)
Westlie $36,992.28 (8 cyl)
Howe reported he is going with the
Westlie bid. Thiesen inquired if
Dickinson’s absence was excused.
Fennewald moved to approve,
Gantzer seconded, all in favor, mo-
tion carried. Meeting adjourned.
