Sealed bids for the Columbarium

(Phase I), North Dakota Veterans

Cemetery, Mandan, North Dakota

will be received by the Adjutant Gen-

eral of the State of North Dakota at

Fraine Barracks, Building 030,

Bismarck, North Dakota, until 2:00

PM, June 18, 2020 and will be

opened and publicly read that date

and hour in the location designated.

All bids received after the scheduled

opening time will be returned to the

bidders unopened. The deadline for

receipt of technical questions is no

later than June 11, 2020. A single

bid will be received for Total Con-

struction work (IFB 20-15). IMPOR-

TANT: Davis-Bacon Wage Rates

are required for this project. ATTEN-

Electronic bidding documents may

be requested. Requests must be

written on your company letterhead

and each request for bidding docu-

ments must be accompanied by a

current North Dakota Contractor’s

License or Certificate of Renewal.

Copies of the bidding documents are

on file at the Construction Plans Ex-

change in Bismarck; Builders Ex-

changes in Dickinson, Fargo, Grand

Forks, Mandan, Minot, Minneapolis,

Minnesota and Rapid City, South

Dakota and at the office of the Archi-

tect. Each bid shall be submitted in

duplicate copy on the forms provid-

ed by the Owner and enclosed in a

sealed opaque envelope upon which

there is disclosed the necessary in-

formation as required by the Supple-

mentary Instructions to Bidders.

Each bid shall be accompanied by a

separate sealed opaque envelope

containing a bidder’s bond made

payable to The Adjutant General,

State of North Dakota, and executed

by the bidder as principle and by a

surety company authorized to do

business in North Dakota, in a sum

equal to five percent (5%) of the

bidder’s highest total bid combina-

tion, including all add alternates to

the bid items; conditioned that if the

bidder’s proposal be accepted and

the contract awarded to him, he

within ten (10) days after notice of

such award, will effect and execute

a contract in accordance with the

terms of his bid and a contractor’s

bond as required by law and the re-

gulations and determinations of the

Owner. AIA Document A310, Bid

Bond, is provided in the electronic

project manual and should be used

to execute the bid guarantee. In

compliance with Section 43-07-12 of

the North Dakota Century Code,

each contractor submitting a bid

must have a copy of his North Dako-

ta Contractor’s License or certificate

of renewal thereof issued by the

Secretary of State enclosed in the

bid bond envelope; must be licensed

for the highest amount of his total

bid combination including add alter-

nates; and such license must have

been in effect at least ten (10) days

prior to the date of the bid opening.

No bid will be read or considered

which does not fully comply with the

provisions herein as to the bid bond

and ND Contractor License, and any

deficient bid submitted will be

resealed and returned to the bidder

immediately. The Owner reserves

the right to hold all legitimate bids for

a period of sixty (60) days after the

date fixed for the opening thereof. It

is the intent of the Owner to award a

contract to the lowest and best

bidder. The Owner further reserves

the right to reject any and all bids

and to waive irregularities, and shall

incur no legal liability for the State

for the payment of any monies until

the contract is awarded and ap-

proved by the proper authorities. In

compliance with Section 48-01.2-10

of the North Dakota Century Code,

the successful bidder shall be re-

quired to furnish payment and per-

formance bonds covering the faithful

performance of the Contract and the

payment of all obligations

thereunder, and all additional obliga-

tions required by the laws of the

State of North Dakota. Each bond

shall be in an amount equal to the

full contract sum.

ta, requesting an Order changing the

name of Samantha Jo Miller (current

full, legal name) to Samantha Jo

Feller (requested full, legal name).

ed application must be given in the

County. You are hereby notified that

thirty days after publication, petition-

er intends to file a petition requesting

entry of the Court’s Order changing

On April 24, 2020, Otter Tail Power

Company filed an application for au-

thority for deferred accounting to

track financial effects of the CO-

VID-19 pandemic and record and

defer such effects as a regulatory

asset. The issue to be considered in

this proceeding is, should the Com-

mission grant deferred accounting

treatment for the financial impacts of

the COVID-19 pandemic? Those in-

terested are invited to comment on

the application in writing. Persons

desiring a hearing must file a written

request identifying their interest in

the proceeding and the reasons for

requesting a hearing. Comments

and requests for hearing must be re-

ceived by July 11, 2020. If deemed

appropriate, the Commission can

determine the matter without a hear-

TELECOMMUNICATIONS RELAY

SERVICE SURCHARGE

May 27, 2020

On April 21, 1993, Governor Edward

T. Schafer approved House Bill No.

1028 that established a program to

provide specialized telecommunica-

tions services and equipment to the

communications impaired. The re-

lay services program is funded by an

access line surcharge paid by the

customers of local exchange com-

panies and radio communications

service providers. The relay services

program is administered by the In-

formation Technology Department of

the State of North Dakota. Before

June 1 of each year, the Public Ser-

vice Commission calculates the

amount of the surcharge based on

cost data and other information pro-

vided by the Information Technology

Department. The Commission has

calculated the 2020-2021 surcharge

to be included in bills to customers is

$.03 per access line per month.
