Dakota will be received by the Adju-

tant General of the State of North

Dakota at Fraine Barracks, Building

030, Bismarck, North Dakota, until

2:00 PM, February 20, 2020, and

will be opened and publicly read that

date and hour in the location desig-

nated. All bids received after the

scheduled opening time will be re-

turned to the bidders unopened.

A single bid will be received for Total

Construction work (IFB 20-08).

IMPORTANT: Davis-Bacon Wage

Rates shall apply to this project.

change in Minneapolis, Minnesota,

and the Owner.

Each bid shall be submitted in dupli-

cate copy on the forms provided by

the Owner and enclosed in a sealed

opaque envelope upon which there

is disclosed the necessary informa-

tion as required by the Supplemen-

tary Instructions to Bidders.

Each bid shall be accompanied by a

separate sealed opaque envelope

containing a bidder’s bond made

payable to The Adjutant General,

State of North Dakota, and executed

by the bidder as principle and by a

surety company authorized to do

business in North Dakota, in a sum

equal to five percent (5%) of the

bidder’s highest total bid combina-

tion, including all add alternates to

the bid items; conditioned that if the

bidder’s proposal be accepted and

the contract awarded to him, he

within ten (10) days after notice of

such award, will effect and execute

a contract in accordance with the

terms of his bid and a contractor’s

bond as required by law and the re-

gulations and determinations of the

Owner. AIA Document A310, Bid

Bond, is provided in the project

manual and should be used to exe-

cute the bid guarantee.

In compliance with Section 43-07-12

of the North Dakota Century Code,

each contractor submitting a bid

must have a copy of his North Dako-

ta Contractor’s License or certificate

of renewal thereof issued by the

Secretary of State enclosed in the

bid bond envelope; must be licensed

for the highest amount of his total

bid combination including add alter-

nates; and such license must have

been in effect at least ten (10) days

prior to the date of the bid opening.

No bid will be read or considered

which does not fully comply with the

provisions herein as to bid bond and

contractor license, and any deficient

bid submitted will be resealed and

returned to the bidder immediately.

The Owner reserves the right to hold

all legitimate bids for a period of thir-

ty (30) days after the date fixed for

the opening thereof. It is the intent

of the Owner to award a contract to

the lowest and best bidder. The

Owner further reserves the right to

reject any and all bids and to waive

irregularities, and shall incur no legal

liability for the State for the payment

of any monies until the contract is

awarded and approved by the prop-

er authorities.

In compliance with Section

48-01.2-10 of the North Dakota Cen-

tury Code, the successful bidder

shall be required to furnish payment

and performance bonds covering the

faithful performance of the Contract

and the payment of all obligations

thereunder, and all additional obliga-

tions required by the laws of the

State of North Dakota. Each bond

shall be in an amount equal to the

full contract sum.

Description

The department intends to reissue a

NDPDES General Permit,

NDG070000, to regulate temporary

discharge activities in the State of

North Dakota. The permit estab-

lishes effluent requirements based

on technology and water quality con-

siderations, prohibitions, best

management practices, and other

conditions applicable to these types

of wastewaters. Anyone desiring

coverage under this permit should

contact the department for further in-

formation.

Tentative Determinations

Proposed effluent limitations and

other permit conditions have been

made by the Department. They as-

sure that State Water Quality Stan-

dards and applicable provisions of

the FWPCAA will be protected.

Information Requests and Public

Comments

Copies of the application, draft per-

mit, and related documents are

available for review. Comments or

requests should be directed to the

ND Dept of Env Quality, Div of Wa-

ter Quality, 918 East Divide Ave,

Bismarck ND 58501-1947 or by cal-

ling 701.328.5210.

All comments received by March 23,

2020 will be considered prior to final-

izing the permit. If there is significant

interest, a public hearing will be

scheduled. Otherwise, the Depart-

ment will issue the final permit within

sixty (60) days of this notice. If you

N.D.C.C. Å’ 43-07-7. Each bidder

MUST enclose a copy of their

Contractor’s License or Certificate of

Renewal, issued by the North Dako-

ta Secretary of State, in their bid

bond envelope, and each license

must be valid and dated at least 10

days prior to the date set for bid

opening, as required under N.D.C.C.

Å’ 43-07-12. The City of Berthold will

not read or consider any bid that

does not fully comply with the re-

quirements above, or the require-

ments of N.D.C.C. Å’ 48-01.2-05.

The City of Berthold will reseal any

deficient bid submitted and return it

to the bidder immediately. Instruc-
