NOTICE OF SALE

Civil No. 51-2018-CV-00127

Notice is hereby given that by virtue

of a judgment of foreclosure by the

District Court the NORTH CENTRAL

JUDICIAL DISTRICT in and for the

County of Ward and State of North

Dakota, and entered and docketed

in the Office of the Clerk of said

Court on July 10, 2019 in an action

wherein Reverse Mortgage Funding,

LLC was Plaintiff and Cheryl D.

Lane (deceased): Unknown Heirs;

Devisees; Legatees; Administrators;

Executors; Creditors of Cheryl D.

Lane; and Other Unknown Persons

Who Might Have a Right of

Redemption from the Mortgage; any

person in possession; The United

States of America, acting by and

through the Secretary of Housing

and Urban Development; were De-

fendants, in favor of Plaintiff and

against the Defendants for the sum

of $169,565.10, which judgment and

decree, among other things, direct

the sale by me of the real property

hereinafter described, to satisfy the

amount of said judgment, with in-

terest thereon and the costs and ex-

penses of such sale, or so much

thereof as the proceeds of said sale

will satisfy; and by virtue of a writ is-

sued to me out of the office of the

Clerk of said Court, I as Sheriff of

Ward County, North Dakota, will sell

the property described in the Judg-

ment to the highest bidder for cash

at public auction at the front door of

the Courthouse in the County of

Ward and State of North Dakota, on

January 15, 2020, at 10:00 AM, to

satisfy the amount due, with interest

thereon, and the costs and ex-

penses of such sale, or so much

thereof as the proceeds of such sale

will satisfy. The property to be sold

is situated in the County of Ward

and State of North Dakota and

described as follows:

Countryside Villas, 3rd Addition

Lot 2, Nedrose-S4 A 2

Together with: Used 2000 Bonna-

villa 52×28 Manufactured Home

Serial No. NEB00A28052S

If the sale is set aside for any rea-

son, the Purchaser at the sale shall

be entitled only to a return of the

deposit paid. The purchaser shall

have no further recourse against the

Mortgagor, the Mortgagee or the

Mortgagee’s attorney. IN TES-

Sawyer City Council Meeting Mon-

day Nov 4th, 2019 7:00pm

Present: Mayor Redding, Council

members: Darkow, Anfinson, Dynes,

Beeter. Staff: Folden & Schmidt

Visitors: Don Krebsbach-Max Muni-

cipal Judge, Rex Weltikol

Call to Order 7:00pm

Visitor issues:

Discussion with ND Municipal Judge

Don Krebsbach about potential

Judge in Sawyer. Weltikol property

-Motion to pay $253.70 total -GA,

2nd-MB, MC. Work will be post-

poned until Spring.

Old Business

Motion to approve Minutes – ED,

2nd-GA, MC.

Motion to approve Financial Reports

-KD, 2nd-ED, MC.

230 3rd Ave NW update -Mayor

talked to executor. Auditor presents

Council with document and letter

from executor as well as City Attor-

ney response to it. According to

everything that has legally been able

to be researched there is no lien or

encumbrance against the property

or against the estate. Attorney to

contact the ND Dept of Health & Hu-

man Services regarding said lien

against the property. Mayor states

the executor has been trying to get

the power line detached from the

home-Mayor states to make the

phone call to Ottertail. Auditor states

Sawyer Fire Chief reviewed the pro-

perty and has declared it a fire and

health hazard. Council concurs wait

until the judge is in place. Discus-

sion on street 120 2nd Ave

NW-Consensus is that if he wants a

yard light he can have it wired to the

house, the City will not pay to have it

installed or pay for monthly electrici-

ty. 345 2nd Ave SW- all garbage

bags are gone but a lot of debris and

cats are currently hiding under it.

Council concurs to leave on the

agenda each month and wait until

the judge is in place and deal with

as an ordinance violation. 40 1st St

NW- Properties are going to auction.

Council discusses bidding. Council

concurs the City has too many other

project on the docket to throw mo-

ney towards it. Building permit for

340 Cent Ave W -Discussion on

permit violation. Auditor confirms

that property is in the City limits.

Council concurs, wait until the judge

is in place and deal with as an ordi-

nance violation. Vacant dilapidated

homes in Sawyer:

37 2nd St NE = Vacant, boarded

up, went back to bank

132 2nd St SE = vacant, went back

to bank-> sold to HUD

43 1st St NW = vacant , boarded up

Council concurs to keep on agenda

and wait until the judge is in place

and deal with as an ordinance viola-

tion.

7 1st St NW has been taken back by

the bank. Concern for multiple an-

imals in the home and condition of

the property. Council concurs, wait

until the judge is in place and deal

with as an ordinance violation.

New Business

Food Truck Ordinance discussion –

needs to be a permit based system.

Auditor will work on it over the

winter. Rate change discussion- The

City for the past several years has

had to supplement the Street &

Highway fund with a transfer from

the General Fund. Some of the other

small communities do charge a

monthly fee to residence for street

lighting. KD states any bill that

comes to the City has to be a direct

pass-through to the residents. Ex-

penses have to be covered by

monthly fee or increased the pro-

perty taxes, one way or the other the

residents need to cover the cost. ED

states that the City has been ab-

sorbing various expenses for years

and the City can no longer afford to

absorb these expenses. Council

concurs. Motion to Approve October
