Bond equal to five percent (5%) of

the amount of the Bid naming the

South Prairie School District No. 70.

The Contractor shall also enclose

within the Bid Bond envelope a copy

of the Bidder’s North Dakota con-

tractor’s License or a copy of their

latest Renewal certifi cate issued by

the Secretary of State as per North

Dakota Century Code 43- 07- 12.

All Contractors who submit Bids

must hold a North Dakota Contrac-

tors License in the highest amount

of their Bids and such license must

have been in effect at least ten (10)

days prior to the date of the Bid

opening. Any Bid not containing

these documents shall not be ac-

ceptable and shall be returned to the

Bidder unopened. The Owner

reserves the right to reject any or all

bids and to waive any informality in

bidding. The successful bidder will

be required to furnish a Payment

Bond, Performance Bond, Insurance

coverages and other requirements

stipulated in the Specifications. No

Bidder may withdraw his Bid within

30 days of the actual date of the

opening.

Siting Application

NOTICE OF OPPORTUNITY FOR

HEARING

November 7, 2019

On January 21, 2019, in Case No.

PU-19-28, Ruso Wind Partners, LLC

(Ruso Wind) filed an application for

a Certificate of Site Compatibility to

construct an up-to 205 MW Ruso

Wind Project (Project) consisting of

up to 60 wind turbine generators and

associated facilities in McLean and

Ward Counties of North Dakota.

Following filing of the application,

the Project was limited to Ward

County, North Dakota.

On June 17, 2019, a public hearing

was held in Minot, North Dakota on

the application.

Subsequent to the public hearing,

Ruso Wind notified the Commission

that it would not be able to install an

Aircraft Detection Lighting System

due to concerns raised by the Minot

Air Force Base, but is open to other

potential light-mitigating technolo-

gies for the Project. Ruso Wind also

notified the Commission that it no

longer has a pending request to in-

terconnect the Project via the exist-

ing Great River Energy Stanton to

McHenry 230 kV Transmission Line

in the Midcontinent Independent

System Operator electric power grid

interconnection, and is analyzing

various interconnection options, in-

cluding with the Southwest Power

Pool electric power grid interconnec-

tion.

Since these facts were not known at

the time of the public hearing, the

Commission is providing the public

an opportunity to comment or re-

quest a hearing specifically on the

lighting and interconnection matters

in relation to the issues to be con-

sidered, which are:

1. Will the location and operation of

the proposed facility produce

minimal adverse effects on the en-

vironment and upon the welfare of

the citizens of North Dakota?

2. Is the proposed facility compatible

with the environmental preservation

and the efficient use of resources?

3. Will the proposed facility location

minimize adverse human and en-

vironmental impact while ensuring

continuing system reliability and in-

tegrity and ensuring that energy

needs are met and fulfilled in an ord-

erly and timely fashion?

Comments and requests for hearing

on the lighting and interconnection

matters must be received by De-

cember 6, 2019. Persons desiring a

hearing must file a written request

identifying their interest in the

proceeding and the reasons for re-

questing a hearing. If deemed ap-

propriate, the Commission can

determine the matter without a hear-

ing.
