These notices shall satisfy two

separate but related procedural re-

quirements for activities to be under-

taken by the City of Minot.

REQUEST FOR THE RELEASE OF

FUNDS

On or about October 25, 2019, the

City of Minot will submit a request to

the U.S. Department of Housing and

Urban Development (HUD) Region

VIII for the release of Community

Development Block Grant National

Disaster Resilience (CDBG-NDR)

funds, under Title I of the Housing

and Community Development Act of

1974, as amended, to undertake a

project known as City of Minot

CDBG-NDR Program: Lutheran So-

cial Services (LSS) Family Shelter

and Affordable Housing Project, for

the purpose of providing a safe, tem-

porary home for families in crisis and

providing affordable housing oppor-

tunities to low- to moderate-income

households. The total budget will be

$6,935,655, with CDBG-NDR funds

totaling $5,800,000. The proposed

LSS Family Shelter and Affordable

Housing Project is located at 1901

S. Broadway, Minot, North Dakota

58701. The proposed project site is

approximately 2.4 acres and con-

sists of three commercial structures:

a one-story restaurant that will

remain in operation on the site, one

two-story multi-unit structure, and

one one-story multi-unit structure.

The latter two structures were previ-

ously a motel and are currently va-

cant. The parcel also consists of a

paved parking area and a green

space. The proposed project would

involve the acquisition of the parcel

and renovation of some existing

structures and the demolition and

clearance of some of the existing

structures to allow for new construc-

tion, based on a

to-be-commissioned architectural

and engineering evaluation of struc-

tural conditions. The proposed pro-

ject would include a six-unit

single-story family homeless shelter,

17 units of affordable housing in a

multi-story building, a congregate

meal site, food pantry and some of-

fice space. In total, up to four build-

ings may be on this site. The shelter

would contain six family units. The

17 affordable housing units would

provide a mix of studio, one- and

two-bedroom units. The parking lot

would be improved as needed and

the green space enhanced to pro-

vide a play area and community gar-

den. The existing restaurant will

remain as is on site.

FINDING OF NO SIGNIFICANT

IMPACT

The City of Minot has determined

that the project will have no signifi-

cant impact on the human environ-

ment. Therefore, an Environmental

Impact Statement under the National

Environmental Policy Act of 1969

(NEPA) is not required. Additional

project information is contained in

the Environmental Review Record

(ERR) on file at the City of Minot,

515 2nd Avenue SW, Minot, North

Dakota, 58702-5006, and may be

examined or copied weekdays 9:00

A.M. to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency

may submit written comments on

the ERR to the City of Minot, P.O.

Box 5006, Minot, North Dakota,

58702-5006. All comments received

by October 24, 2019 will be con-

sidered by the City of Minot prior to

authorizing submission of a request

for release of funds. Comments

should specify which Notice they are

addressing.

ENVIRONMENTAL

CERTIFICATION

The City of Minot certifies to HUD

Region VIII that Mr. Shaun Sipma in

his capacity as Mayor consents to

accept the jurisdiction of the Federal

Courts if an action is brought to en-

force responsibilities in relation to

the environmental review process

and that these responsibilities have

been satisfied. HUD Region VIII’s

approval of the certification satisfies

its responsibilities under NEPA and

related laws and authorities, and al-

lows the City of Minot to use Pro-

gram funds.

OBJECTIONS TO RELEASE OF

FUNDS

HUD Region VIII will accept objec-

tions to its release of funds and the

City of Minot’s certification for a

period of 15 days following the anti-

cipated submission date or its actual

receipt of the request (whichever is

later) only if they are made on one of

the following bases: (a) the certifica-

tion was not executed by the Certify-

ing Officer of the City of Minot (b)

the City of Minot has omitted a step

or failed to make a decision or find-

ing required by HUD regulations at

24 CFR Part 58; (c) the grant reci-

pient or other participants in the

development process have commit-

ted funds, incurred costs or under-

taken activities not authorized by 24

CFR Part 58 before the approval of

a release of funds by HUD Region

VIII; or (d) another Federal agency,

acting pursuant to 40 CFR Part

1504, has submitted a written finding

that the project is unsatisfactory

from the standpoint of environmental

quality. Objections must be prepared

and submitted in accordance with

the required procedures (24 CFR

Part 58, Sec. 58.76) and shall be ad-

dressed to U.S. Department of

Housing and Urban Development,

Region VIII Office, 8ADE, 1670

80202-4801. Potential objectors

should contact HUD to verify the ac-

tual last day of the objection period.

upon you, by serving upon the un-

dersigned attorney an answer or oth-

er proper response within

twenty-one (21) days after the ser-

vice of this Summons upon you, ex-

clusive of the day of service. If you

fail to do so, judgment by default will

be taken against you for the relief

demanded in the Complaint. You are

hereby notified that pursuant to Rule

8.4 of the North Dakota Rules of

Court, you must comply with the fol-

lowing provisions: (1) Neither

spouse shall dispose of, sell, en-

cumber, or otherwise dissipate any

of the parties’ assets, except: (a) For

necessities of life or for the neces-

sary generation of income or preser-

vation of assets; or (b) For retaining

councel to carry on or contest the

proceeding. If a spouse disposes of,

sells, encumbers, or otherwise dissi-

pates assets during the interim

period, that spouse shall provide to

the other spouse an accounting

within thirty (30) days. (2) Neither

spouse shall harass the other

spouse. (3) All currently available in-

surance coverage must be main-

tained and continued without change

in coverage or beneficiary designa-

tion. (4) Neither spouse shall re-

move any of their minor children

from North Dakota without the writ-

ten consent of the other spouse or

order of the court except for tem-

porary periods. IF EITHER SPOUSE

VIOLATES ANY OF THESE PRO-

VISIONS, THAT SPOUSE MAY BE

IN CONTEMPT OF COURT.
