and Site Restoration Project No.

3755.15

The City of Minot, through the use of

State of North Dakota funds, Depart-

ment of Housing and Urban

Development (HUD) Community

Development Block Grant Disaster

Recovery (CDBG-DR) funds, and

Department of Housing and Urban

Development National Disaster

Resilience (NDR) funds, purchased

houses that were inundated during

the 2011 Souris River Flood and is

now seeking a Contractor to demol-

ish structures at approximately 2

properties. Basement excavation

and site restoration will also be com-

pleted. The City of Minot invites the

public to bid upon the following pro-

ject: 2019 Round 4 STRUCTURE

DEMOLITION AND SITE RES-

TORATION PROJECT No. 3755.15.

The City Council City of Minot

reserves the right to reject any or all

bids and to award the contract as it

deems to be in the best interest of

the City of Minot. Each bidder must

provide a bid bond in the amount of

5% of the bid and contractor’s

license, which are to be included in

a separate envelope attached to the

outside of the bid. Each bidder must

include a copy of their North Dakota

Waste Hauler’s Permit (MSW), and

their Hazardous Waste Disposal

Plan WITH their bid. It should also

be noted that any addendums that

may be issued prior to bid opening

must be acknowledged on the out-

side of the bid envelope. The suc-

cessful, responsible Bidder will be

required to sign the Contract and fur-

nish the appropriate performance

and payment bonds in the amount of

the total bid, and in accordance with,

the State of North Dakota. The bond

is required in order to secure the

performance obligations of the Con-

tractor. The Contract will not be exe-

cuted, nor will work begin, should

the successful Bidder fail to furnish

the performance and payment

bonds required. This Contract shall

be subject to liquidated damages as

stated in the bidding documents,

which will be charged against the

contractor for each day past the

completion date stated in the Con-

tract or as amended by change ord-

er. Bidding documents for the pro-

ject may be viewed at the CDM

Smith Disaster Recovery Office or

Minot’s Builder’s Exchange. Bidding

documents may be obtained at the

CDM Smith Disaster Recovery Of-

fice located at the Arrowhead Mall,

1600 2nd Ave SW, Suite 27, Minot,

North Dakota. Bid proposals must

be submitted on the forms provided.

A mandatory pre-bid conference will

be held at the City Hall located at

515 2nd Ave SW, Minot, North

Dakota at 10:00 A.M. (CST) on Sep-

tember 19, 2019 to discuss the bid-

ding documents, followed by site

visits to the project sites. Sealed

bids will be received up to the hour

of 10:00 A.M. (CST) on September

26, 2019, at the City Hall. All bids

will be opened at 10:00 A.M. on the

same day. The project is being fund-

ed, in part, with CDBG-DR funds.

Therefore, the Bidder will be re-

quired to comply with all Federal,

State, and Local regulations. These

requirements include compliance

with Section 3 employment plan,

and the Contractor must ensure that

employees and applicants for em-

ployment are not discriminated

against because of their race, color,

religion, sex or national origin. The

City of Minot reserves the right to

determine the lowest responsible

and eligible bidder, to waive irregu-

larities, and to reject any or all bids.

The City of Minot strongly en-

courages maximum participation in

all bids by qualified Disadvantaged

Business Enterprises (DBEs),

Minority Business Enterprises

(MBEs), and Women Business En-

terprises (WBEs), small businesses,

and by local construction and demol-

ition companies, as prime contrac-

tors and as subcontractors.

the State of North Dakota, acting

through the State Water Commis-

sion, invites and will receive sealed

proposals for the procurement of

Northwest Area Water Supply

(NAWS) Project Biota Water Treat-

ment Plant, Contract 7-2A DAF

Equipment Procurement up to the

hour of 1:30 p.m., local time, on

September 19, 2019 where and at

which time they will be opened and

read aloud. Proposals shall conform

to and be responsive to the Contract

Documents for the work. The Con-

tract Documents will be available on

The scope of Work consists of

Design Phase Services to be com-

pleted during the final design of the

new Biota Water Treatment Plant,

Construction Phase Services includ-

ing furnishing equipment and provid-

ing installation oversight, startup,

warranties and guarantees, and

training services for the system

described below and in the project

documents. Proposal includes all the

equipment and ancillary items

necessary for the complete con-

struction of two identical Dissolved

Air Flotation (DAF) clarifier trains.

The DAF system will consist of float

scrapers, float beaches, saturator

system and compressors, recycle

system, effluent laterals, control

panels, and any other equipment

and instrumentation necessary for a

complete system. Installation of the

system and supply and discharge

connections needed for the com-

plete installation shall be provided

by an Installation Contractor under a

separate contract. Any special or

non-standard fittings required for in-

stallation shall be provided by the

DAF System supplier under this

contract. Integration for the system

with plant SCADA systems will be

performed by others with the assis-

tance of the DAF System supplier.

All equipment shall be new and

unused. The contract documents

may be downloaded at no charge

from the bidder portal of the ND

State Office of Management and

Budget website at:

https://apps.nd.gov/csd/spo/services

/bidder/main.htm. The Advertise-

ment for Procurement Proposals,

Planholders List, Addendums, and

Results will also be available by fol-

lowing the “Bid Info” link at

www.houstoneng.com. Optional pa-

per copies may be obtained from

Houston Engineering, Inc. upon re-

ceipt of payment of $100.00 per set,

non-refundable. Each proposal shall

be submitted on the forms furnished

as part of the contract documents

and must be accompanied by a

separate envelopecontaining a Bid

security submitted in a separate en-

velope and made payable to the

North Dakota State Water Commis-

sion in an amount of five percent of

Bidder’s maximum Bid price and in

the form of a certified check, bank

money order, or a Bid Bond (on form

EJCDC No. C-430, 2013 Edition) is-

sued by a surety meeting the re-

quirements of Paragraph 4.01.B of

the General Conditions. If a Bid

Bond is provided, a Power of Attor-

ney, Acknowledgement of Surety,

and Acknowledgement of Principal

shall be included in the separate en-

velope with the Bid Bond. A propo-

sal submitted without this informa-

tion properly enclosed in the bid

bond envelope shall not be read nor

considered and the envelope shall

be resealed and proposal returned

to the bidder immediately. Each pro-

posal shall be sealed and delivered

to the North Dakota State Water

Commission at the location desig-

nated in this notice for the opening

of proposals at or before the time in

this notice provided. The successful

Bidder must be an Approved Vendor

in accordance with NDCC

54-44.4-09 prior to the Award of the

Contract. The bidder shall include

such registration or a covenant to

supply such information within the

bidder’s proposal. Bidders on this

work will be required to comply with

the President’s Executive Order

Nos. 11246 as amended, 11518,

and 11625 as amended. The re-

quirements for bidders and contrac-

tors under these orders are ex-

plained in the specifications. Bidders

are advised that the funding and/or

regulatory agency for this project (in

whole or in part) is the US Bureau of

Reclamation (USBR). A mandatory

Pre-Bid Conference Call with the

Engineer will be held on September

12, 2019 at 1:30 p.m. local time. All

Bidders ARE REQUIRED to partici-

pate. The conferencing details are

provided in the Contract Documents.

The State of North Dakota, acting

through the State Water Commis-

sion, reserves the right to select the

schedule(s) under which the bids

are to be compared and contract(s)

awarded, to reject any and all bids,

to determine whether a bidder is

responsive and responsible and to

waive any and all irregularities in

any bid. In accordance with the com-

petitive sealed proposal solicitation

requirements, the State Water Com-

mission may choose to conduct dis-

cussions with bidders to make cla-

rifications, when necessary, to en-

sure bidder responsiveness to the

solicitation. These bidder discus-

sions, in accordance with NDAC

4-12-12, will be made after bid open-

ings and prior to issuance of a notice

of intent to award and may alter or

otherwise change the conditions,

terms, and price of the proposed

contract. The Bidders shall fully

complete all Bid Sheets contained in

the Bid Form. The Owner reserves

the right to hold the three low Bids

for a period of sixty-one (61) calen-

dar days after the date of the bid

opening to complete the financial ar-
