Suspended sentence for three narcotics-related offenses
A Minot man has been given a suspended sentence after pleading guilty to three narcotics-related felonies in North Central District Court on Nov. 26.
Brian Thomas Koons, 30, Minot, entered a change of plea, pleading guilty to one Class B felony count of possession with intent to manufacture/deliver-fentanyl, and two Class C felony counts of fleeing a peace officer-vehicle-fleeing from felony and possession of cocaine, second offense. Additional counts of possession with intent to manufacture/deliver-methamphetamine, unlawful possession of drug paraphernalia-second offense, reckless driving and driving under suspension-alcohol related were all dismissed in accordance with the plea agreement.
According to court documents, a Ward County Sheriff’s deputy was on patrol on Feb. 8, when a call went out from a Minot Police officer regarding a reckless driver in a gray Chevrolet pickup that had run multiple stop signs. The deputy was in the same area as the pickup was reportedly in and intercepted the vehicle near Fourth Avenue Southeast. According to the affidavit of probable cause, the pickup accelerated at speeds nearing 100 mph.
The pursuit ended when the pickup finally entered a driveway in the 500 block of Sixth Avenue Northeast, and a felony stop was conducted. Koons was identified as the lone occupant of the vehicle and was detained for fleeing. A search of the vehicle located a bag containing blue M30 fentanyl pills, about 28 grams of methamphetamine, a small amount of cocaine and various drug distribution paraphernalia.
Judge Todd Cresap sentenced Koons to 10 years with the Department of Corrections and Rehabilitation, to first serve 184 days with credit for 184 days already served. Koons was ordered to complete three years of supervised probation upon release, along with a chemical dependency evaluation. He also was ordered to pay $775 in court fines and fees.
