Suspended sentence for sharing explicit video of minor
A Minot woman has been sentenced to time served and supervised probation after pleading guilty to sharing an explicit video of a minor.
Tatiana May Schlak, 19, Minot, entered a change of plea to guilty in North Central District Court on Nov. 26, pleading guilty to the dissemination of obscene material, a Class C felony. One count of possession of certain materials prohibited, a Class C felony, was dismissed in accordance with a plea agreement.
According to court documents, Minot Police received a report from the parent of the victim that she had been sent two explicit videos of her daughter by Schlak.
The videos had previously been reported by the juvenile after they were circulated on public platforms in November 2023. The victim said she had given someone permission to use the phone briefly, who then recorded the videos with another phone, and never returned the device. She told the officers she was younger than 16 at the time the videos were recorded.
Investigators contacted Schlak, who admitted she had recorded and sent the video to the victim’s parents to make them aware of what was going around about the victim. According to the affidavit of probable cause, despite claiming she had deleted the video, a search of Schlak’s cellphone located both videos on the phone.
Judge Gary Lee sentenced Schlak to serve a suspended sentence of 360 days in the Ward County Jail, to be followed by 360 days of supervised probation. According to court documents, the Class C felony will be deemed a misdemeanor upon Schlak’s successful completion of supervised probation. The state has indicated it will resist any early termination of Schlak’s probation.
Schlak was ordered to have no contact with the victim or her family and not go within 150 feet of their residence. She also was assessed $525 in court fines and fees. The device determined to contain the prohibited content was ordered to be forfeited and destroyed.
