Supreme Court expands family mediation to help parents reach agreement on custody issues during pandemic

The North Dakota Supreme Court issued guidance Wednesday on how to manage child custody disputes during the ongoing coronavirus pandemic.

Parents who share custody of a child and are trying to work out custody and visitation arrangements during the pandemic will have access to a free family mediation program, according to a statement on the Supreme Court website. Family mediators can help resolve any disputes between the parents over parenting time without a court visit.

According to the statement, the expanded mediation program will be available to parents who have an existing court order for parenting time. The mediation will take place within one to seven days of an online application being made and a determination will be made within three days after the mediation has taken place.

The statement affirms that existing court orders regarding custody and parenting time are still in effect during the pandemic. They can’t be changed without a new court order. But the Supreme Court says that parents should work together to ensure that the child’s contact with each parent is as close as possible to what it normally would be. Mediation is intended to help them come to an agreement.
