Judge rejects plea deal for Brandon Galonek in GSI case

Judge Doug Mattson rejected a plea deal on Thursday that would have called for Brandon Galonek, 21, to serve five years in prison for having sex with a 14-year-old girl when he was 19.

Mattson said evaluations done of Galonek show that he has an above average to high risk to reoffend. Mattson said he cannot accept the guilty plea and resulting plea deal in the interest of public safety.

The plea deal called for Galonek to enter a guilty plea to Class A felony gross sexual imposition and be sentenced to 10 years, with five years suspended, and five years of supervised probation. He would also have been required to register as a sex offender.

Previous lawyers for Galonek have said that Galonek has a low IQ and a developmental disability. Galonek has said he cannot read. Mattson said he questions whether Galonek will be able to lower his high average to high risk of reoffending because of his limitations.

According to court documents, Galonek had sex with the girl at a friend’s house on June 27, 2018. The girl was too young to legally consent.

Mattson said a new pretrial conference date to discuss the case will be set.
