Jamie Schmidt, Winnipeg, now charged with possession of child pornography

Jamie Frederick Douglas Schmidt, 44, Winnipeg, Manitoba, who was charged in August with Class B felony luring a minor by computer, is now also charged with Class C felony possession of child pornography.

Schmidt made an initial appearance in district court in Minot on Monday on the new charge before Judge Gary Lee. He remains free on the previous bond that has been set.

According to a probable cause affidavit filed with the court, police found explicit images of an identified, underage teenage boy on Schmidt’s phone after they obtained a search warrant for the phone.

Schmidt’s lawyer, Ryan Sandberg, has filed a motion to suppress the evidence found on the phone. Sandberg argues in a brief that Schmidt’s Fourth Amendment right against unreasonable search and seizure were violated and that the police did not obtain a search warrant within the 10-day time frame required by the North Dakota Rules of Criminal Procedure. A hearing on the motion to suppress is scheduled for Feb. 3 before Lee.

Schmidt was initially charged in August after he allegedly traveled to Minot to meet a 14-year-old boy in hope of having sex. The boy did not exist, according to the probable cause affidavit filed with the court in that case. Schmidt had been communicating through the spring and the summer with a fictitious profile set up by the Ward County Sheriff’s Department on Grindr, an app used primarily by gay men who are seeking sex with other gay men.
