Minot man sentenced for stabbing brother

A 24-year-old Minot man was sentenced to time served and probation for stabbing his brother on Feb. 9.

Court records show that Timothy Wade Allery pleaded guilty to the Class C felony aggravated assault charge on Friday. Judge Gary Lee sentenced him to 360 days in jail, with a requirement that he serve the 117 days he has already spent in jail, and three years of supervised probation. He must also pay $1,100 in court costs and obtain a chemical dependency evaluation. The sentence is concurrent with one for a bail jumping charge. Allery was also ordered to have no contact with his brother. The assault charge will appear as a Class A misdemeanor on his record if he successfully completes probation.

According to court documents, the victim was sleeping in his bedroom and woke to find Allery in the living room on Feb. 9. The man told Allery to leave and Allery pulled out a folding knife with a 3-inch blade and stabbed the man in his left forearm. The victim fought off Allery with a vacuum cleaner. The victim was treated at Trinity Hospital for a stab wound.
