NOTICE IS HEREBY GIVEN that

Renae O’Neill and Jeremy O’Neill

have filed herein a Petition for Adju-

dication of Intestacy, Adjudication for

Priority of Appointment of Personal

Representative, and Appointment of

Personal Representativefor the

estate of Timothy J. Edgley, de-

ceased. Hearing has been set upon

said Petition on the 14th day of

February, 2022, at 9:00 a.m. at the

Courtroom of the above named

Court in the City of Minot, County of

Ward, State of North Dakota, and

any person may appear and be

heard. IT IS FURTHER ORDERED

that in order for any objection to be

considered, objections to the Peti-

tion for Adjudication of Intestacy, Ad-

judication for Priority of Appointment

of Personal Representative, and Ap-

pointment of Personal Representa-

tive must be in writing and must be

filed with the Court and the attorney

for the Petitioner no later than seven

(7) days prior to the date set for

thorough account of the facts upon

NOTICE OF PUBLIC HEARING

The City of Minot Planning Com-

mission will meet in regular session

on Tuesday, February 1, 2022 at

5:30 p.m. in the Council Chambers

of City Hall located at 515 2nd Ave.

SW to hold public hearings on the

items contained in this published no-

tice.

Each item is available for review and

on file at the Minot City Public

Works building located at 1025 31st

St. SE, Minot, ND 58702 between

8:00am and 4:30pm Monday

through Friday preceding the public

hearing. Chapter 9.1 and Article 10

of the Minot Land Development Or-

dinance provides the relevant

application procedures pertaining to

each application, including protest

and appeals available, for each

respective application type. In-

terested members of the public are

Public hearing request on an appli-

cation from Blake Nybakken

representing Henry Land Holding,

LLC for a zoning map amendment

from “C1” Neighborhood Commer-

cial District to “C2” General

Commercial District with a “PUD

Overlay” Planned Unit Development.

The proposal seeks to establish

seven midrise buildings

up to 90 feet tall with four of the

seven buildings comprised of com-

mercial on the first floor and residen-

tial on the second floor and above.

The remaining three buildings will be

solely residential use. The proposal

will include 468 residential units, ap-

proximately 53,277 s.f. of commer-

cial space, and two public plazas.

Two additional buildings to accom-

modate drive-thru food retail are

also proposed. A plat containing 12

lots is also proposed to delineate the

various buildings and uses on the

site and is to be known as

Highlander Estates Fourth Addition.

The subject property is legally

described as Lot 13, Highlander

Estates Subdivision, Section 34,

Township 155N, Range 83W, Ward

County, North Dakota.

The property is unaddressed and is

located west of 2251 36th Ave. SW

and north of the new Trinity Health

hospital.
