NOTICE IS HEREBY GIVEN that

the City of Flaxton, North Dakota will

receive sealed Bids for the

construction of LEAD SERVICE

LINE REPLACEMENT at

Ackerman-Estvold, 1907 17th Street

SE, Minot, North Dakota, until 10:30

AM Monday, October 4, 2021.

All Bids must be submitted, and all

work shall be done, in full and strict

compliance with:

1. The Plans & Contract Documents

for this project;

2. Any Special Conditions for this

Generally, the Work covered by the

Plans and Specifications for Lead

Service Line Replacement consists

of the materials, labor, tools, and

equipment for required replacement

verified lead service lines. There are

a total of 74 services, 73 service

lines require hydrovacing to verify

pipe material. 1 lead service line has

been identified as a lead service line

and can be replaced without hydro-

vacing. Until the other 73 service

lines have been verified by hydro-

vacing, for bidding purposes provide

the cost to replace all remaining 73

service lines in the Base Bid. All ver-

ified service lines identified as not

being lead will be deducted from

the Contract by Change Order at

1/73 of the cost excluding hydrovac-

ing. On average a new water service

line will consist approximately 60 LF

of 1″ copper service line from the

water main to within 5′ outside the

building. The Work to replace a ser-

vice line shall also include 1 water

main saddle, 1 corporation stop, 1

curb stop with box, connection 5′

outside of the building to existing

water service line, the removal and

replacement of existing pavement /

graveled surfaces as necessary for

the installation of the water service

line, and other incidentals. Details of

the construction are included in

the Drawings and Project Manual.

The work shall be completed by

December of 2022. Of the 73 exist-

ing service lines requiring verifica-

tion, the North Dakota Rural Water

Systems Association representative

anticipates approximately 15% will

be lead service lines.

All Bids are to be submitted on the

basis of cash payment for the Work

and Materials necessary to complete

the project. Each bid must be ac-

companied by a separate envelope

containing the contractor’s license

and bid security. The bid security

must be in a sum equal to five per-

cent of the full amount of the bid and

must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of Advertisement for Bids

City of Flaxton, Lead Service Line

Replacement 00 1100 – 2 the bid

and the bid bond and any condition

of the governing body. A countersig-

nature of a bid bond is

not required under this section. If a

successful bidder does not execute

a contract within the ten days

allowed, the bidder’s bond must be

forfeited to the Owner and the

project awarded to the next lowest

responsible bidder. Bidders must be

licensed for the full amount of the

bid as required by section 43-07-

12 of the North Dakota Century

Code.

Bidders on this work will be required

to comply with Title 40 CFR Part 33-

Participation by Disadvantaged

Business Enterprises in the United

States Environmental Protection

Agency Programs. The require-

ments for bidders and contractors

under this regulation concern utiliza-

tion of Minority Business Enterprises

(MBE),Women’s Business

Enterprises (WBE), and Small

Business Enterprises (SBE) and are

explained in the specifications.

The goal for MBE is 2% of the total

dollar value of the project. The goal

for WBE is 3% of the total dollar

value of the project.

Bidders shall demonstrate a good

faith effort to solicit for MBE and

WBE subcontractors. The completed

MBE/WBE Solicitation Information

sheet must be provided in the outer

bid security envelope. Failure to

include this information will result in

the bid not being opened. No Bid

may be read or considered if it does

not fully comply with the

requirements of Section 48-01.2-05

of the North Dakota Century Code.

Bidders on this work will be required

to comply with the President’s

Executive Order No. 11246, as

amended.

The requirements for bidders and

contractors under this order are

explained in the specifications.

The Owner reserves the right to hold

all Bids for 45 days, to reject any or

all Bids, to waive any informality

or irregularity in any Bid, to accept

the Bid deemed in the best interest

of the Owner, and to rebid the

project until a satisfactory bid is

received.

There shall be endorsed upon the

outside of the envelope containing

the Bid, the following:

1. “City of Flaxton, North Dakota,

Lead Service Line Replacement”

2. The name of the person, firm,

corporation, or joint venture

submitting the Bid.

3. The Bidder’s Contractor’s License

or Contractor’s License Renewal

Number.

4. Acknowledgement of the Adden-

da, if any.

Any deficient Bid received will be

resealed and returned to the Bidder

immediately. All work shall be sub-

stantially complete by November 1,

2022. All work shall be completed

and ready for final payment in accor-

dance with the General Conditions

within 60 calendar days of the sub-

stantial completion dates. Should

the Contractor fail to complete its

obligations under the Contract within

the time required herein or within

such extra time as may have been

granted by formal extensions of time

approved by the Owner, there will be

deducted from any amount due to

the Contractor the sum of $500 per

day for each and every calendar day

that the completion of the Work is

delayed. The Contractor and his

Surety will be liable for any excess.

Such payment will be as and for

liquidated damages and not as a

penalty.

8/2/21 Burlington city council meet-

ing. Present: J Kabanuk, R Kremer,

son, citizens & visitors. Kremer

moved to approve 7/6/21 minutes,

Walker second, motion carried by

gineer’s report was explained by

Samson. City was awarded ND

HMG for $102,700 for proposed

generator with a 15% local cost

share + any cost over-run. Walker

moved to proceed with the generator

Walker moved to award the en-

gineering agreement to Prairie En-

gineering & authorize mayor to sign

the agreement, Kremer second, mo-

tion carried by unanimous roll call

vote. Walker moved to send the

letter Samson drafted to the State

Water Commission requesting rais-

ing our water input, Kremer second,

motion carried by unanimous roll call

vote. Walker moved to accept a new

handbook as presented, Kremer

second, motion carried by unani-

mous roll call vote. S Skees

resigned from council July 2021,

City of Burlington thanks her for her

service. A special meeting is to be

held 8/18/21 to appoint a new coun-

cil member. Walker moved to ap-

prove Roger Domres replat of lots

1,2 & 3 Evergreen Second Addn,

Ward Co., Cannon Second, motion

carried by a unanimous roll call vote.

Walker moved to approve a 5% cost

of living raise for 2022 for, Cannon

second, motion carried by a unani-

mous roll call vote. Walker moved to

budget for a 10% raise for all con-

tingent on evaluations. Kremer

second, motion carried by a unani-

mous roll call vote. Cannon moved

to have the budget include the third

police officer, excluding the potential

10% raise, Walker second, motion

carried by a unanimous roll call vote.

Walker moved to amend the motion

of a 10% raise for all to say budget

for a 10% raise for all, Cannon

second, motion carried by a unani-

mous roll call vote. Cannon moved

to approve preliminary budget after

changes, Kremer second, motion

carried by a unanimous roll call vote.

September 7, 2021

Mayor Tollefson called the meeting

to order at 7:07 p.m. with roll call

taken and recital of the Pledge of Al-

legiance. All members agreed to ap-

prove the agenda with adjustments

made to the amount of pending

claims to be paid and removal of

resident Knipp’s public appearance,

per her request. Along with that, ac-

ceptance was made to have discus-

sion about unfinished business of

Executive meeting information, pro-

gress of Diane Fugere’s lawsuit as

well as address new business items

of fencing at 908 Surrey Avenue and

September Legend Lawn Care ser-

vice. Gantzer/Fennewald MSP to

approve the August Regular and

Preliminary Budget Special meeting

minute sets. Johns/Fennewald MSP

to approve the August Payroll To-

tals, Financial Reports, and Vouch-

ers to be paid as provided. Chief

Howe reported that the new pickup

had arrived, and that Officer Hill is

currently going through training.

Tom with AE2S gave an update on

the sidewalk project and provided a

report addressing concerns regard-

ing the level of grade on 5th street

being inadequate especially in front

of Volks’ residence and at the

Church. They will be addressing

drainage issues before a final walk-

through is complete. All members

agreed it would have best to have

raised the whole sidewalk on 5th

street but cannot proceed now with

the total cost to remove and repour

falling solely on the City. Upon invi-

tation, resident Tyrell Kraft spoke to-

wards the status of his home being

removed and replacing it with a new

one as originally permitted. Chris

Coffee appeared acting as newly as-

signed representative for Silver

Springs. The members agreed that a

meeting could be held between

Silver Springs with the City En-

gineer, Public Works, North Prairie

and an agreement could be worked

on throughout the winter months so

building can be made ready for

spring. Johns/Fennewald MSP to

approve the 2nd and Final Reading

of Amendment to Zoning Ordinance

7.0102 Article 10 Subsection D stat-

ing that shipping or Conex con-

tainers following IOS standards shall

not be permitted on any property

zoned R1, R2, R3, or R4 under

Surrey City Ordinance 12.0501. The

topic of forming committees was

opened for discussion with members

having been previously assigned for

Prairie Dog but still pending for Ordi-

nance according to the motion that

was made at June’s Regular meet-

ing. Ms. Johns moved to rescind her

motion approve the First Reading of

Amendments to Chapters 2 and 3 of

the Surrey City Ordinance with pro-

posed revisions and further send

them to a committee. Mr. Fennewald

also seconded his action to rescind.

Mayor Tollefson appointed Kim

Shaw, Laura Volk, Heather Thorson,

along with Attorney Schult to make

up the members of an Ordinance

Committee. Further direction was

provided to have the ordinances tak-

en off the City website while it is

under construction posting only

current material. Credit Card pro-

gram options were researched with

details provided. Fennewald/Gantzer

MSP moved to eliminate accepting

credit card payments with the City’s

current provider for licensing and

permits since those transaction re-

quire further paperwork to be com-

plete. Confirmation was made that

the City has not received formal no-

tice of response from NDIRF to date.

Mr. Schultz stated he would be

adaptable and adhere to member

preference of public announcement

made after each Executive session.

Gantzer/Dickinson MS to hire Chris

Wolla as the City’s individual build-

ing inspector at $44.00 an hour per

build adjusting the permit fees ac-

cordingly and giving proper notice to

Ward County. Roll Call Vote: Ms.

Gantzer-Aye, Mr. Dickinson-Aye,

Mr. Clark-Aye, Ms. Johns-Aye, Ms.

Wheeler-Aye, Mr. Fennewald-Aye.

Motion passed. All members agreed

that the employees are to meet and

decide what is best for their health

coverage needs. The Mayor made

announcement placing emphasis on

the cost of the Special Election.

Johns/Wheeler MSP to approve

lagoon soil sample testing and solicit

for bids to fix the plug in the line

between lagoon cells 2 and 3. All

members agreed to follow ND State

retention schedule with attorney

recommendation to keep recordings

for 2 at least years. All members

agreed the dumpsters provided at

the parks should be handled by the

Park District. All members agreed

that relocation of fencing be

between property owners to meet

regulation. Meeting adjourned at

9:55 p.m.
