e-waste will be collected at the City
of Minot Public Works building, 1025
31st St SE. The household hazar-
dous waste will be collected from
City of Minot garbage collection pa-
trons only, free of charge (please
bring identification). This service is
part of the City of Minot Sanitation
Utility. Household hazardous waste
includes items labeled danger,
flammable, corrosive, toxic or poiso-
nous, such as:

Minutes of the Board of Ward
County Commissioners
August 17, 2021
The regular meeting of the Ward
County Commission was called to
order by Chairman Fjeldahl at 9:02
AM with Commissioners, Anderson,
Pietsch, Rostad, and Weppler
present. Also present were depart-
ment heads Bradley Starnes, Dana
Larsen, Emily Burkett, Jason
Blowers, Kristin Kowalczyk, Marisa
Haman, Melissa Bliss, Noreen Bar-
ton, Robert Roed, Roza Larson, and
Tammy Terras.
Moved by Comm. Rostad, seconded
by Comm. Pietsch to approve the
agenda. Roll call; all voted yes; mo-
tion carried.
Moved by Comm. Weppler, second-
ed by Comm. Anderson to approve
Commission Meeting Minutes from
August 3, 2021. Roll call; all voted
yes; motion carried.
Moved by Comm. Rostad, seconded
by Comm. Weppler to approve the
regular bills totaling $1,543,737.23
and Human Service Zone direct cost
bills totaling $6,904.70. Roll call; all
voted yes; motion carried.
Mr. Jeff A. Hoverson, Pastor of Liv-
ing Word Church in Minot, 66th
House Representative appeared be-
fore the Commission with a resolu-
tion regarding vaccines. Discussion
was held.
Travis Zablotney of Minot appeared
regarding North Dakota Century
Code addressing the powers of
counties.
Shannon Krueger, resident of Dis-
trict 3 and Ward County appeared
and stated concerns with District 3
representatives.
Austin Fercking, a Minot resident,
appeared stating concerns in re-
gards to federal government in-
terference and would like Ward
County to protect people’s individual
rights.
Lisa Clute, First District Health,
spoke over the phone stating she
can provide names of infectious
disease doctors that have done ex-
tensive research on COVID if need-
ed. Ms. Clute also stated that with
required school vaccinations, there
is a way to opt out of vaccine re-
quirements.
Chairman Fjeldahl spoke regarding
the vaccine passport issue and is
unsure how much Ward County
plays a part in private business with
their requirements of employees be-
ing vaccinated.
Jay Lundeen, a resident of District
40, appeared to discuss information
from the CDC website.
Further discussion was held re-
garding this issue and concerns of
the people.
Moved by Comm. Pietsch, second-
ed by Comm. Weppler to table the
Vaccine Passport issue to enable
more time to review the information
received today. Roll call; all voted
yes; motion carried.
Human Resource Director Tammy
Terras congratulated Ward County
Employee Misty Hester who at-
tended and graduated from the
NACO High Performance Leader-
ship Academy. Ms. Hester present-
ed what she learned during the
12-week academy to the Commis-
sion. The Commission then present-
ed her with graduation materials.
Highway Engineer Dana Larsen ap-
peared regarding the Sliver Widen-
ing Project along County Road 14.
Moved by Comm. Weppler, second-
ed by Comm. Pietsch to award the
Sliver Widening Project on County
Road 14 to Farden Construction for
the amount of $731,721.25 and au-
thorize the Chairman to sign the
contract. Roll call; all voted yes; mo-
tion carried.
Doug Diedrichsen, Planning and
Zoning Administrator, appeared re-
garding an application for an Outlot
Plat for Norman Sollid for the follow-
ing described property: Proposed
Outlot 1 lying in the NE4NE4 &
SE4NE4. The applicant is proposing
to parcel Outlot 1 of 2.37 acres. This
outlot is for future residential pur-
poses. Ward County Zoning applies
with the township recommendation
pending; however, the 60-day win-
dow has now expired on this plat.
The proposed outlot meets minimum
zoning requirements for Ward Coun-
ty. Planning Commission recom-
mended approval at their June 2021
meeting of the Subdivision Plat Ap-
plication based on finding of facts
and staff recommendations.
Moved by Comm. Rostad, seconded
by Comm. Weppler to approve the
Outlot Plat Application for Norman
Sollid as recommended by Planning
& Zoning Committee. Roll call; all
voted yes; motion carried.
Mr. Diedrichsen presented an up-
date on the Zoning Ordinance
amendments and informed the
Commission the draft of the updated
Zoning Ordinances has been re-
ceived from the consultant and has
been emailed to the Planning and
Zoning Committee.
Human Resource Director Tammy
Terras appeared and provided a
Compensation Study update.
Moved by Comm. Weppler, second-
ed by Comm. Anderson to approve
the following payroll amendments: T.
Snellings, State’s Attorney and J.
Gonzalez, State’s Attorney. Roll call;
all voted yes; motion carried.
Melissa Bliss, Human Service Zone
Director appeared to discuss the
Memorandum of Understanding
between the Ward County Commis-
sion and Youthworks, which is a
building agreement regarding the
use of the 24/7 building which
houses shelter care and attendant
care.
Moved by Comm. Weppler, second-
ed by Comm. Pietsch to approve the
contract with changes noted to the
last item through December 31,
2022. Roll call; all voted yes; motion
carried.
Emily Yanish, Program Manager for
Youthworks in Bismarck, appeared
regarding short-term shelter care
and the need for this service. In
April, 2021, Youthworks suspended
accepting youth from other counties
due to a potential damage and liabil-
ity issue. More than a dozen youth
have been turned away due to this
closure. Ms. Yanish hopes with a
Memorandum of Understanding
showing intent of use and an agreed
upon cost to be billed to the custodi-
al entities, that at-risk youth from
other counties can be served
through this program.
Further discussion was held on the
services as well as the rate for reim-
bursement.
Moved by Comm. Weppler, second-
ed by Comm. Anderson to approve
Youthworks presenting the Commis-
sion with a Memorandum of Under-
standing for other counties for re-
view. Roll call; all voted yes; motion
carried.
Moved by Comm. Anderson,
seconded by Comm. Rostad to re-
move the 2nd Amendment Resolu-
tion from the table. Roll call; all vot-
ed yes; motion carried.
Moved by Comm. Pietsch, second-
ed by Comm. Rostad to accept the
Sheriff’s and State’s Attorney’s
Resolution recommendation on the
2nd Amendment rights and Ward
County’s affiliation and feelings to-
wards that. Motion was withdrawn
pending confirmation of two
separate resolution documents.
Travis Zablotney appeared with con-
cerns that the State’s Attorney
Resolution was ineffective. He pro-
posed the Board support the Resolu-
tion of the Ward County Board of
Commissioners and the Ward Coun-
ty North Dakota Second Amend-
ment Preservation Act supplied by
him and included in meeting docu-
ments.
Sheriff Robert Roed appeared and
stated the local law enforcement
cannot restrict 2nd Amendment
rights. Sheriff Roed feels Ward
County would be making a state-
ment showing support for the 2nd
Amendment with the Resolution. In
regard to the Preservation Act
presented, Sheriff Roed, as well as
State’s Attorney Roza Larson, ex-
pressed concern in regard to item 4a
which gives the Sheriff’s Department
authority to arrest a federal agent
upon violation of state laws or coun-
ty ordinances.
A discussion ensued.
Jasahd Stewart of Minot appeared in
support of Sheriff Roed and the
Resolution and Second Amendment
Preservation Act.
Wendy Baggaley of Minot, appeared
in support of the Resolution and
Second Amendment Preservation
Act provided by Mr. Zablotney.
Greg Demme, resident of District 3
in the Minot area, appeared in favor
of the Resolution and Second
Amendment Preservation Act to pro-
tect and defend Ward County ci-
tizens.
State’s Attorney Roza Larson ap-
peared regarding the actions re-
quested. Ms. Larson feels a Reso-
lution sends a clear message to the
State and Federal Government that
we are advocating for the 2nd
Amendment rights of Ward County
citizens and no further restrictions
on 2nd Amendment rights.
In regard to the Preservation Act,
Ms. Larson explained the Board of
County Commissioners only has the
authority given to it by statute. The
ability to pass ordinances in Home
Rule 11-09.01.05, Subsection 8
does not confirm the authority to re-
gulate any industry or activity which
is regulated by state law or by the
laws adopted by state agencies. She
then stated local law enforcement
agencies are prohibited from helping
federal agents enforcing federal
laws which are not consistent with
our state laws. Ms. Larson stated
concerns that the act gives authority
to arrest a federal agent but does
not give a level of offense, penalty,
and does not address what the
Sheriff or the State’s Attorney’s of-
fice would do after a federal officer is
arrested. Ms. Larson also voiced
concern regarding the restriction of
hiring put forth in the agreement.
Moved by Comm. Anderson,
seconded by Chairman Fjeldahl to
approve the Ward County North
Dakota Second Amendment Preser-
vation Act without the arresting sec-
tion (4 and 4a). Roll call; Comm.
Anderson and Fjeldahl voted yes;
Comm. Rostad, Weppler and
Pietsch voted no. Motion failed.
Moved by Comm. Rostad, seconded
by Comm. Pietsch to direct our
State’s Attorney clean up and
rewrite the sections questioned
above with the help of the Sheriff to
be presented at the next
Commissioner’s meeting in Sep-
tember. Roll call; all voted yes; mo-
tion carried.
Auditor/Treasurer Marisa Haman ap-
peared.
Moved by Comm. Weppler, second-
ed by Comm. Anderson to receive
and file the Economy at a Glance
correspondence and receive and file
monthly reports including financials.
Roll call; all voted yes; motion car-
ried.
Moved by Comm. Anderson,
seconded by Comm. Pietsch to ap-
point Comm. Weppler as the
NDACo County Delegate. Roll call;
all voted yes; motion carried.
Moved by Comm. Rostad, seconded
by Comm. Weppler to appoint Chair-
man Fjeldahl as the NDACo County
Alternate Delegate. Roll call; all vot-
ed yes; motion carried.
Moved by Comm. Weppler, second-
ed by Comm. Rostad to authorize
Chairman Fjeldahl to sign for per-
mission to construct, operate, in-
spect, maintain an SRT fiber optic
cable at 439 17th Street NW in
Minot. Roll call; all voted yes; motion
carried.
Moved by Comm. Weppler, second-
ed by Comm. Anderson to approve
duplicate warrants to be issued to
General Equipment, Leana Leavitt,
Williamson Development, and Main
Electric to be issued to

ed by Comm. Rostad to approve the
gaming site authorization for
Pheasants for the Future. Roll call;
all voted yes; motion carried.

2nd Addition Lot 1 Block 1). Applica-
tion has been made to the City
Council for a moving permit to move
this structure, and a public hearing
will be held on September 20, 2021,
at 5:30 p.m. in City Council
Chambers at City Hall (515 2nd Ave-
nue SW). Anyone objecting to the
granting of the permit to move this
structure should make their protest
known and appear in opposition to
the granting of this permit. Further
