Notice is hereby given that the

County Commissioners of the Coun-

ty of Ward, North Dakota, will re-

ceive proposals for the following pro-

jects:

BRR-0051(053) – PCN 22773 &

BRO-0051(054) – PCN 22782

Ward County is seeking proposals

from prequalified engineering firms

to perform construction engineering

on the following projects in Ward

County Scheduled to be completed

by October 15, 2021.

BRR-0051(053) PCN 22773

The removal of structure, installation

of reinforced box culverts, grading,

drainage, surfacing, and incidentals

of structure #51-107-12.1, located

one mile east of Kenaston (four

miles south of Kenmare, North

Dakota).

The removal of structure, installation

of new structure, grading, drainage,

surfacing, and incidentals of struc-

ture #51-129-27.1 over the Des Lacs

River, four miles east and 3 miles

south of Carpio, North Dakota.

The removal of structure, installation

of reinforced box culverts, grading,

drainage, surfacing, and incidentals

of structure #51-106-13.1, one mile

east and one mile south of Kenaston

(four miles south of Kenmare, North

Dakota).

Work to be performed by Consultant

includes: Inspection, Survey, Materi-

als Testing, Coordination, and

measuring and computing pay quan-

tities. Firms submitting proposals

must be prequalified with NDDOT to

perform the construction engineering

activities identified above. Firms

may hire sub-consultants to perform

work outside of their prequalified

area of expertise.

Selection will be on the basis of the

following criteria:

Past performance; Ability of profes-

sional personnel; Willingness to

meet time and budget requirements;

Recent, current, and projected work-

loads of the persons and/or firms;

Related experience on similar pro-

jects; Recent and current work for

the agency; and Project understand-

ing, issues, & approach.

Ward County will only consider pro-

posals received at the office of the

Ward County Engineer (200 72nd

58701-5005) prior to 2:00 P.M., De-

County reserve the right to reject

Lampkins, by and through his attor-

cause of action against the Defen-

dant, alleges as follows:

1. The parties have been residents

of the State of North Dakota for at

least the last six (6) months preced-

ing the commencement of this ac-

tion;

2. The Plaintiff and Defendant were

married on December 6, 2018, in

Minot, North Dakota, and ever since

have been and are now husband

and wife;

3. The parties separated on or

around August 16, 2019.

4. No other proceedings for Dissolu-

tion of Marriage or Legal Separation

have been commenced by either

party and are presently pending in

this state or any other jurisdiction;

5. Defendant is a member of the

armed services;

6. The parties have no children to-

gether. Defendant is not now preg-

nant, and no children are expected

to be born as a result of this mar-

riage;

7. The Plaintiff and Defendant have

acquired personal property during

their marriage, which requires an

equitable distribution;

8. The Plaintiff and Defendant have

incurred certain debts and obliga-

tions during their marriage which re-

quire an equitable distribution;

9. Irreconcilable differences exist

between the Plaintiff and Defendant,

which makes the continuance of the

marriage intolerable;

WHEREFORE, the Plaintiff prays for

judgment as follows:

1. For an absolute decree of divorce

from the Defendant;

2. For a fair and equitable division

and distribution of the property accu-

mulated by the parties during their

marriage;

3. For a fair and equitable division

and assignment of the debts accu-

mulated by the parties during their

marriage;

4. That neither party be obligated to

pay or receive spousal support; and

5. For any other such other relief

that the Court deems just and prop-

er.

The regular meeting of the Ward

County Commission was called to

order by Chairman Fjeldahl, at 9:15

AM with Commissioners, Rostad,

Pietsch, Walter and Weppler

present. Also present were depart-

ment heads Bradley Starnes, Dana

Larsen, Jason Blowers, Jennifer

Wiechmann, Kerrianne Boetcher,

Kristin Kowalczyk, Leona

Lochthowe, Marisa Haman, Melissa

Bliss, Robert Roed, Roza Larson

and Tammy Terras.

Moved by Comm. Pietsch, second-

ed by Comm. Weppler to approve

the agenda. Roll call; all voted yes;

motion carried.

Moved by Comm. Weppler, second-

ed by Comm. Walter to approve the

minutes of the Regular Commission

Meeting on October 20, 2020 and

Special meeting on October 20,

2020. Roll call; all voted yes; motion

regular bills totaling $283,200.34

and Human Service Zone Direct

cost bills totaling $12,776.24. Roll

Human Services Zone Director

Melissa Bliss appeared with a

recommendation regarding ap-

pointment of Human Service Zone

Board members with expiring terms

December 31, 2020. She is recom-

mending advertising for two of the

open positions and appointing a

County Commissioner for one posi-

tion.

Moved by Comm. Rostad, seconded

by Comm. Walter to approve the

recommendation from Ms. Bliss re-

garding the Human Service Zone

Board appointments. Roll call; all

voted yes; motion carried.

Ms. Bliss continued regarding the

Human Service Zone plan. During

the Human Service Zone board

meeting there had been questions

and changes discussed regarding

the plan.

Moved by Comm. Weppler, second-

ed by Comm. Pietsch to table the

approval of the Human Service Zone

plan until December 1, 2020 meet-

ing. Roll call; all voted yes; motion

carried.

Ms. Bliss will also bring Human Ser-

vice Zone HR manual addendums

before the Commission during the

December 1, 2020 meeting.

Director of Emergency Management

Jennifer Wiechmann informed the

Commission the County will need to

pay for the cost of a COVID home-

less shelter upfront. The County will

then be reimbursed 75% of the costs

through a FEMA Public Assistance

Grant. The remaining 25% cost will

be divided equally between the

County and the City of Minot per a

verbal agreement. Ms. Wiechmann

is recommending a Memorandum of

Understanding be signed between

Ward County and the City of Minot.

Moved by Comm. Weppler, second-

ed by Comm. Pietsch to approve

Ms. Wiechmann’s recommendation

and sign a Memorandum of Under-

standing with the City of Minot re-

garding cost sharing of a COVID

homeless shelter and that the

County’s 12.5% portion of the 25%

cost share be funded using the

CARES Act funds. Roll call; all voted

yes; motion carried.

Major Paul Olthoff appeared re-

questing the Commission write off

an invoice from 2017 for housing of

an inmate for the FBI. The amount

requested to be written off is

$180.00.

Moved by Comm. Walter, seconded

by Comm. Weppler to approve Ma-

jor Olthoff’ s request and write off

the invoice totaling $180.00. Roll

call; all voted yes; motion carried.

County Engineer Dana Larsen

presented the Commission with a

recommendation from the County

Highway Committee regarding Rice

Lake right of way encroachments.

The Committee is recommending

the County Commission notify

residents at Rice Lake that are en-

croaching upon public right of way.

Moved by Comm. Weppler, second-

ed by Comm. Rostad to move the

Rice Lake right of way discussion to

the County Park Board for their in-

put. Roll call; Commissioners

Weppler, Rostad and Walter voted

yes, Commissioners Pietsch and

Fjeldahl voted no; motion carried.

Planning and Zoning Administrator

Doug Diedrichsen appeared with

four plats for the Commissions con-

sideration.

Tina Newberg submitted a plat appli-

cation for the following described

property: Proposed Outlot 14, NW4

of Section 8-153-81. The applicant is

proposing to parcel Outlot 14 a

2.00-acre parcel for future residential

purposes. Ward County zoning ap-

plies with no recommendation re-

ceived for the McKinley Township.

The proposed outlot meets the zon-

ing requirements for Ward County.

by Comm. Weppler to approve the

plat application for Tina Newberg

based on Planning and Zoning Com-

mission recommendation. Roll call;

all voted yes; motion carried.

Robert Barfield submitted a plat ap-

plication for the following described

property: Proposed Outlot 3 being all

of Sublot A of Outlot 1 and portion of

Outlot 1 lying in the SW 4 of section

27-154-84. The applicant is propos-

ing to parcel Outlot 3 a 3.00 acre

parcel for future commercial pur-

poses. Burt Township zoning applies

with a recommendation of denial

form the township based on the stat-

ed intended use of the property by

the applicant. The proposed outlot

meets the minimum lot size required

by Burt Township.

ed by Comm. Walter to deny the plat

application for Robert Barfield based

on the Planning and Zoning Com-

mission and Burt Township’s recom-

mendation. Roll call; all voted yes;

motion carried.

Shawn and Ashley Bailey submitted

a plat application for the following

described property: Proposed Outlot

4 and 5 being all of Outlot2 lying in

the SW4SE4 in section 10-152-83.

The applicant is proposing to parcel

Outlot 4 an 8.36-acre parcel and

Outlot 5 a 17.18-acre parcel. The

outlots are for future residential pur-

poses. Gasman Township zoning

applies with the township recom-

mending approval. The proposed

outlots meets the zoning require-

ments in Gasman Township.

applies with the township recom-

due to lack of a second.

Grant. She stated courtrooms are in

need of window covering and carpet

is needed in judges’ rooms. They

are also wanting to convert one of

the courtrooms into a jury room.

Ms. Lochthowe requesting bids for

the Courthouse Improvement grant

NOTICE OF TEMPORARY

RESTRAINING PROVISIONS

Under Rule 8.4 of the North Dakota

Rules of Court, upon service of this

summons, you, and your spouse,

are bound by the restraints following:

1) Neither spouse shall dispose of,

sell, encumber, or otherwise dissi-

pate any of the parties’ assets, ex-

cept:

a. For necessities of life or for the

necessary generation of income or

preservation of assets; or

b. For retaining counsel to carry on

or to contest the proceeding.

If a spouse disposes of, sells, en-

cumbers, or otherwise dissipates as-

sets during the interim period, that

spouse shall provide to the other

spouse an accounting within thirty

(30) days.

2) Neither spouse shall harass the

other spouse.

3) All currently available insurance

coverage must be maintained and

continued without change in cover-

age or beneficiary designation.

IF EITHER SPOUSE VIOLATES

ANY OF THESE PROVISIONS,

THAT SPOUSE MAY BE IN CON-

TEMPT OF COURT.
