Mayor Tollefson read Century Code

statute allowing an Executive Ses-

sion. Mayor Tollefson stated the

next item on the agenda is Attorney

Consultation regarding the investiga-

tion of the Surrey Truther. This item

must be discussed in executive ses-

sion. The authority of closing this

portion of the meeting is North

Dakota Century Code section(s)

44-04-19.1 Subsections 5 & 9. The

topic of the executive session is At-

torney Consultation regarding the in-

vestigation of the Surrey Truther.

Mayor Tollefson asked for a motion

to go into executive session.

Melissa Suko appeared before

council for approval of her Condi-

tional Use Permit to allow her to use

her RV camper as an extension of

her home-based business. They are

open Tuesdays, Thursdays and Fri-

days from 10:30 am to 6 pm, provid-

ing health consultations along with

professional line supplements for

overall health and immune systems.

Due to the Covid-19 pandemic she

feels it is in her best interest to use

the camper for her business needs,

minimizing exposure of clients to her

home. Much discussion followed.

The Planning & Zoning Commission

recommended approval of the per-

mit with the following conditions: 1.

The permit be valid only during the

time Covid 19 exists. 2. The permit

be reviewed on a 6-month basis. 3.

The entrance to the camper require

rails be added to the steps for en-

trance safety purposes. 4. The

camper be parked behind the set-

backs. 5. The camper does not

violate Ordinance 16.901 Article 9.

Fennewald moved to deny the re-

quest, Mayor Tollefson called for a

second twice, motion died for lack of

a second. Dickinson moved to ap-

prove the permit for a 3 month term

with and with all the conditions sug-

gested by Planning and Zoning be-

ing met, to be revisited at the regular

council meeting January 2021;

Attorney Schultz discussed the eth-

ics ordinance he is proposing. He

would like to see a committee

formed to review the ordinance and

amend as needed. Dickinson move

to not approve the ordinance; Fen-

Fennewald – yes; Christianson –

yes; Thiesen – no; Gantzer – no;

motion passed.

Council discussed reviewing and up-

dating the city ordinances as need-

ed. Christianson moved to set up a

committee made up of one council

member and 2 city residents,

Thiesen seconded; Christianson –

yes; Thiesen -yes; Gantzer – yes;

Fennewald – yes; Dickinson – yes,

motion passed. Fennewald moved

to appoint Christianson chair of the

committee, Dickinson seconded,

discussion. Fennewald withdrew his

motion. Mayor Tollefson appointed

Elaine Christianson chair of the

committee and the following

members: Terra Knipp and Diane

Fugere. The committee will choose

one more member.

Council discussed the purchase of a

dump truck from Kelsey Fred. Fen-

newald moved to approve purchase;

Christianson – yes; Dickinson – yes,

motion carried.

Due to an error in motion at the Au-

gust 3, 2020 meeting regarding

Chief Howe’s wages, Dickinson

moved to approve the chief wages

at $18,250 per year or $23.75 per

hour, Fennewald seconded; Dickin-

son – yes; Fennewald – yes; Chris-

tianson – yes; Thiesen – yes;

Gantzer – yes, motion carried.

Fennewald discussed the subpoe-

nas served on Fugere and Waller

and past staff and council members.

He would like the city to cover the le-

gal fees regarding this matter.

Gantzer asked if Dickinson was

qualified to deliver subpoenas. Wall-

er asked about losing work

time/comp time/vacation time if re-

quired to take time off for a deposi-

tion. Discussion followed. Fen-

newald moved to create a fund for

legal fees for the subpoenas issued

to Diane Fugere, AJ Waller, Jason

Vaagen, Karla Walsh, Luis Coca

and Heather Brandt, Gantzer

streaming and sound to record city

– yes; Dickinson – yes; motion car-

ried.

Memorandums of Understanding

between the Cornerstone Pres-

byterian Church and the Surrey Pub-

lic School and Ward County Emer-

gency Management were presented

for signature. Christianson moved to

authorize Mayor Tollefson to sign,

Fennewald seconded; Christianson

– yes; Fennewald – yes; Thiesen –

yes; Gantzer – yes; Dickinson – yes;

motion carried.

Waller asked about hydrant re-

placement. Two new hydrants were

budgeted for in 2020 but not the cost

to install them and he wants direc-

tion on this. Thiesen moved to add

$5,000 to the budget for the installa-

tion with Waller informing Public

Works Commissioners on progress,

Waller asked about blading all the

gravel roads in town. Discussion fol-

Waller asked about taking the old

unusable plow to 4 Acres Welding to

Trana discussed the Chili Cook Off

the Park Board is sponsoring Sep-

tember 26th. Big Dog Saloon is re-

1st St SW north of the city hall build-

ing. Fennewald moved to approve

the special liquor license, raffle per-

mit, with the fee waived, and closure

of the street, Thiesen seconded;

Trana asked about leaving the elec-

tric on at the RV dump all year due

to a residence on the line now and

how to address the bill for

Surrey Final Budget Meeting

9/8/2020

Present: Chuck Tollefson, Steve

Fennewald, Elaine Christianson,

Twila Gantzer, Mike Thiesen, Brent

Dickinson. Absent: Jenny Johns.

Also present: Diane Fugere, Anita

Trana, AJ Waller, Kevin Howe &

Anna Olson.

Fugere reviewed the proposed final

budget with council. Chief Howe

spoke about increasing the wages

for the chief in the event the position

becomes full-time. He suggested

$30 per hour. Discussion on using a

dedicated fund for full-time chief

wages. Fennewald discussed in-

creasing the part-time clerk wages

to $25,000.00 in case more hours

were necessary. The following

changes were requested: Increase

Chief of Police wages by $44,500 in

the General Fund – Increase Clerk

wages to $25,000 in the General

Fund. Gantzer moved to approve

the final budget with changes re-

quested for the Chief of Police

wages and clerk wages, Christian-

son seconded, motion carried.
