Each bid must be accompanied by a

separate envelope containing the

bid security in a sum equal to five

percent of the full amount of the bid

and must be in the form of a bidder’s

bond. A bidder’s bond must be exe-

cuted by the bidder as principal and

by a surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond,

and any condition of the City of

Minot, as required by law. A counter-

signature of a bid bond is not re-

quired. If the City of Minot elects to

award a contract to the lowest

responsible bidder, and the lowest

responsible bidder does not execute

a contract within the ten days al-

lowed, the bidder’s bond must be

forfeited to the City of Minot and the

project awarded to the next lowest

responsible bidder. Each bidder

must possess a valid North Dakota

contractor’s license for the full

amount of their bid, as required by

Section 43-07-07 of the North Dako-

ta Century Code. Each bidder MUST

enclose a copy of their Contractor’s

License or Certificate of Renewal, is-

sued by the North Dakota Secretary

of State, in their bid bond envelope,

and each license must be valid and

dated at least 10 days prior to the

date set for bid opening, as required

under Section 43-07-12 of the North

Dakota Century Code. No bid may

be read or considered if it does not

fully comply with the requirements of

Section 48-01.2-05 of the North

Dakota Century Code, and any de-

ficient bid submitted will be resealed

and returned to the bidder immedi-

ately. All Bids submitted and all

Work completed must be as stipulat-

ed in the Agreement. The City of

Minot reserves the right to hold all

Bids for a period of 30 days after the

date of the bid opening, to reject any

or all Bids, and to waive any infor-

mality or irregularity in any Bid, and

to rebid the project until a satisfac-

CITY OF MINOT REQUESTS FOR

SEALED BIDS

The City of Minot, North Dakota is

requesting sealed bids for salvage-

able items, located within structures

that were purchased by the City

within the footprint of the flood con-

trol project. Items will be sold as-is

with no guarantee or warranty to

their condition or soundness. Each

bid must include either 1) the entire

bid amount or 2) a five (5) percent

bid bond in a separate envelope at-

tached to the bid envelope. Accept-

able will be cashier checks, bidder

bond, or cash. Any outstanding bal-

ance must be paid within five (5)

days of highest bid award. Items are

being sold as a package, not indivi-

dually. The winning bidder acquires

rights to all advertised salvageable

items within the structure at the

designated address. Items must be

removed at winning bidder’s ex-

pense, within 10 business days of

bid award. Items left beyond

timeframe are considered forfeited

and subject to demolition with the

structure. Exceptions require City

approval. Access to structures shall

be coordinated through the City of

Minot Property Maintenance depart-

ment and winning bidder shall en-

sure structure remains secure upon

departure. Debris and/or damage

created by item removal shall be the

winning bidder’s responsibility.

tures, to include homes, for sale that

were purchased by the City within

the footprint of the flood control pro-

ject. Structures will be sold as-is with

no guarantee or warranty to their

condition or soundness. Those

designated with “**” have

lead-based paint or asbestos hazard

information available. Each bid must

include a five (5) percent bid bond in

a separate envelope attached to the

bid envelope. Acceptable will be

cashier checks, bidder bond, or

cash. Any outstanding balance must

be paid within fifteen (15) days of

highest bid award. Land is not in-

cluded as part of this auction. Struc-

tures must be removed and relocat-

ed outside the 2011 flood inundation

area at winning bidder’s expense.

Winning bidder must provide desti-

nation address, obtain any neces-

sary moving permits and coordinate

removal plan through City of Minot

property maintenance within thirty

(30) days of bid opening. Debris

and/or damage created by structure

removal shall be the winning

bidder’s responsibility. For safety

concerns, structures must remain

in-place until after May 1, 2020 and

then have 60 days to remove. Ex-

ceptions require City approval. Any

desired winterizing must be per-

formed by winning bidder at their

own expense. The City reserves the

right to demolish structures left in

place beyond the deadline. Demoli-

tion of basement/slab is City respon-

sibility. All structures moved must

follow jurisdictional ordinances and

zoning codes in place at the per-

manent location of the structure.

Structures remaining in the City of

Minot’s jurisdictional boundaries re-

quire a certificate of occupancy be

issued within six (6) months of bid.

The following is a list of structures

available to the highest bidder. De-

tached garages and sheds are con-

sidered separate items that require

an independent bid from the home

structure. Home and

commercial-type structures have a

minimum bid based on availability

and assessed tax value. Sheds and

garages have no minimum bid price.

These notices shall satisfy two

separate but related procedural re-

quirements for activities to be under-

taken by the City of Minot.

REQUEST FOR THE RELEASE

OF FUNDS

On or about March 30, 2020, the

City of Minot will submit a request to

the U.S. Department of Housing and

Urban Development (HUD) Region

VIII for the release of Community

Development Block Grant National

Disaster Resilience (CDBG-NDR)

funds, under Title I of the Housing

and Community Development Act of

1974, as amended, to undertake a

project known as City of Minot

CDBG-NDR Program: Blu on Broad-

way Project, for the purpose of pro-

viding affordable housing opportuni-

ties to low- to moderate-income

(LMI) households.

The total budget will be $8,013,694,

with CDBG-NDR funds totaling

$4,750,000.

The proposed Blu on Broadway pro-

ject would involve the transfer of

ownership of 1629 S. Broadway,

Minot, North Dakota, and construc-

tion of a five-story mixed-use

development on the 1.39-acre site.

The proposed project would include

approximately 10,000 square feet of

commercial space on the main floor,

and 42 affordable housing rental un-

its on floors two through five. The

units will be studio, one- or

two-bedrooms, will serve LMI house-

holds, and will be reserved as af-

fordable units for a period of 20

years. Five units will be designed to

meet ADA accessibility standards.

The proposed project would include

24 underground spaces within a

nearly 10,000 square-foot parking

garage. In addition, 56 surface park-

ing spaces are proposed.

The proposed project would also in-

clude a nearly 10,000 square-foot

outdoor recreation area, installation

of an approximate 24-feet high by

13-feet wide community video board

with a 6.5-feet high by 12-feet wide

LED screen, and reconstruction of

the public right-of-way on 1st Street

SW. Reconstruction would extend

from 16th Avenue SW to 17th Ave-

nue SW, nearly 600 linear feet.

Reconstruction activities would in-

clude installing and/or replacing wa-

ter main, sidewalks, lighting, curbs,

curb cuts and storm sewers, as well

as leveling, milling and resurfacing

the paved roadway.

FINDING OF NO SIGNIFICANT IM-

PACT

The City of Minot has determined

that the project will have no signifi-

cant impact on the human environ-

ment. Therefore, an Environmental

Impact Statement under the National

Environmental Policy Act of 1969

(NEPA) is not required. Additional

project information is contained in

the Environmental Review Record

(ERR) on file at the City of Minot,

515 2nd Avenue SW, Minot, North

Dakota, 58702-5006, and may be

examined or copied weekdays 9:00

A.M. to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency

may submit written comments on

the ERR to the City of Minot, P.O.

Box 5006, Minot, North Dakota,

58702-5006. All comments received

by March 30, 2020 will be con-

sidered by the City of Minot prior to

authorizing submission of a request

for release of funds. Comments

should specify which Notice they are

addressing.

ENVIRONMENTAL CERTIFICA-

TION

The City of Minot certifies to HUD

Region VIII that Mr. Shaun Sipma in

his capacity as Mayor consents to

accept the jurisdiction of the Federal

Courts if an action is brought to en-

force responsibilities in relation to

the environmental review process

and that these responsibilities have

been satisfied. HUD Region VIII’s

approval of the certification satisfies

its responsibilities under NEPA and

related laws and authorities, and al-

lows the City of Minot to use Pro-

gram funds.

OBJECTIONS TO RELEASE OF

FUNDS

HUD Region VIII will accept objec-

tions to its release of funds and the

City of Minot’s certification for a

period of 15 days following the anti-

cipated submission date or its actual

receipt of the request (whichever is

later) only if they are made on one of

the following bases: (a) the certifica-

tion was not executed by the Certify-

ing Officer of the City of Minot (b)

the City of Minot has omitted a step

or failed to make a decision or find-

ing required by HUD regulations at

24 CFR Part 58; (c) the grant reci-

pient or other participants in the

development process have commit-

ted funds, incurred costs or under-

taken activities not authorized by 24

CFR Part 58 before the approval of

a release of funds by HUD Region

VIII; or (d) another Federal agency,

acting pursuant to 40 CFR Part

1504, has submitted a written finding

that the project is unsatisfactory

from the standpoint of environmental

quality. Objections must be

prepared and submitted in accor-

dance with the required procedures

(24 CFR Part 58, Sec. 58.76) and

shall be addressed to U.S. Depart-

ment of Housing and Urban

Development, Region VIII Office,

Denver, Colorado 80202-4801. Po-

tential objectors should contact HUD

to verify the actual last day of the

2020 – 2021 AIRPORT HAYING

AGREEMENT

MINOT INTERNATIONAL

AIRPORT

GENERAL

The intent and purpose of this Re-

quest for Bids is to solicit bids from

interested parties seeking to be

responsible for cutting, baling, and

removing hay from designated areas

of the Minot International Airport pro-

perty beginning May 2020 and end-

ing October 31, 2021.

SCOPE OF WORK

The contract will be for cutting, bal-

ing, and removing hay from desig-

nated areas of airport property. The

designated areas equate to approxi-

mately 700 acres; a figure has been

included for reference. The winning

bidder will be responsible for com-

plying with all applicable airfield re-

gulations including access control,

security badge training for all per-

sonnel pending successful back-

ground check results, coordination

with Airport Operations and Air Traff-

ic Control as necessary, and compli-

ance with the airport’s Wildlife Ha-

zard Management Plan (WHMP) (a

copy of which is available, upon re-

quest, from the Airport Operations

Manager). Among other things, the

airport’s WHMP recommends: hay

cutting be done prior to seed produc-

tion; hay not be stored on the airfield

and thus be moved to perimeter

fence lines and removed off premise

after baling; all existing alfalfa crop

be naturally diminished and con-

verted to grass over time; manage

airfield vegetation and agricultural

activity in a manner that poses the

least amount of wildlife attractants. If

the haying contractor wishes to seed

with an approved grass, such seed-

ing will be done at the contractor’s

sole expense and only with the writ-

ten pre-approval of the Airport

Operations Manager.The successful

bidder will be required to provide a

series of bale counts and weigh slips

for hay removed from the airfield;

certified scales must be used for

weighing. Weigh slips and bale

counts must be provided to the air-

port in advance of payment. Pay-

ment will be made within 30 days

after final bale removal for the sea-

son and will only be accepted if

corresponding counts and slips are

received. Airport Operations

reserves to right to perform indepen-

dent bale counts and weighing.

BID SPECIFICATIONS

The bid price shall be expressed in

dollars per ton. The bid price per ton

shall remain the same for any

second or repeated cuttings made at

any point during the contract. Suc-

cessful bidder will be required to

complete a badge application and

criminal history background check

needed for badge issuance; associ-

ated fees will be at the bidder’s own

cost. Successful bidder will also be

required to maintain proper and suf-

ficient insurance to indemnify the

City of Minot/Minot International Air-

port from any injury or damages

which may arise out of successful

bidder’s operation and performance

per the scope of work outlined

above. Limits of the policy shall be

at least $1 Million per occurrence

and $2 Million in the general aggre-

gate. Bids must contain the name

and phone number of the individual

with whom communication can be

made. All submittals must be re-

ceived at the address and by the

date and time specified herein. All

submittal envelopes must be sealed

and clearly marked, “Request for

Bids – Minot International Airport

Haying Services.” The City of Minot

reserves the right to extend the Re-

quest for Bids submittal date for any

reason. The City of Minot reserves

the right, at any time, to reject any

and all submittals, make requests for

new RFBs, and to accept any sub-

mittal and make award of a contract

that is deemed to be in the best in-

terest of the City of Minot and the

Minot International Airport. The City

Clerk of the City of Minot will receive

sealed bids at the City Clerk’s Office

at City Hall (515 2nd Avenue SW,

2nd Floor), Minot, North Dakota, un-

til 11:00 AM on March 24, 2020.

ND 58505. On August 28, 2019,

Montana Dakota Utilities Co. (MDU)

filed an application for an Advance

Determination of Prudence (Case

No. PU-19-306) and for a Certificate

of Public Convenience and Necessi-

ty (Case No. PU-19-307) to con-

struct, own and operate an 88 MW

simple cycle combustion turbine re-

ferred to as Heskett Unit 4. The tur-

bine is to be located adjacent to

Heskett Unit 3, near Mandan, North

Dakota. MDU states the primary

need for Heskett Unit 4 is to offset

the retirement of three coal-fired

power plants: 1) Lewis and Clark

Unit 1 located near Sydney, Monta-

na, 2) Heskett Unit 1 located near

Mandan and 3) Heskett Unit 2 locat-

ed near Mandan. MDU states that

these coal-fired power plants are no

longer economical. On September

16, 2019, MDU filed an application

for deferred accounting treatment of

costs related to its proposed retire-

ment of the Lewis and Clark Unit 1,

Heskett Unit 1 and Heskett Unit 2

until disposition of its next general

electric rate case. MDU proposes to

accelerate depreciation of the

coal-fired power plants to an expect-

ed early retirement date. On March

4, 2020 The Commission consolidat-

ed the cases for public hearing.

The issues to be determined in Case

No. PU-19-306 are:

1. Whether MDU’s proposed

resource addition is prudent.

2. Whether the Commission should

grant MDU an advance determina-

tion of prudence.

The issues to be determined in Case

No. PU-19-307 are:

1. Whether public convenience and

necessity will be served by construc-

tion and operation of the facilities.

2. Whether the applicant is fit, wil-

ling, and able to provide service.

The issues to be considered in Case

No. PU-19-317 are:

1. Whether MDU’s proposed early

plant retirements are reasonable

and appropriate?

2. Whether MDU’s proposal for ac-

celerated depreciation should be ap-

proved?
