NOTICE IS HEREBY GIVEN that

the City of Minot (Owner) is request-

ing Bids for the construction of the

following Project: City Hall Retaining

Walls 1 & 2 (4398). Bids for the con-

struction of the Project will be re-

ceived at the office of the City Clerk

located at 515 Second Avenue SW

(Second Floor), Minot, North Dako-

ta, 58702 until 18, February, 2020 at

11:00 am local time. At that time the

Bids received will be publicly opened

and read. The Project includes the

following Work: Demolition of an ex-

isting grouted rock slope, and instal-

lation of a large block retaining wall

(approx. 200LF), soldier pile retain-

ing wall with concrete or precast

concrete façade (approx. 975LF),

concrete valley gutters and moment

slabs, steel stairs and aluminum

guardrails, asphalt pavement, park-

ing lot lighting, striping and

bidding documents are also avail-

able at the Issuing Office – KLJ,

$100. Potential bidders may contact

KLJ at 701-232-5353 with any addi-

tional questions. Each bid must be

accompanied by a separate en-

velope containing the bid security in

a sum equal to five percent of the

full amount of the bid and must be in

the form of a bidder’s bond. A

bidder’s bond must be executed by

the bidder as principal and by a

surety, conditioned that if the

principal’s bid is accepted and the

contract awarded to the principal,

the principal, within ten days after

notice of the award, shall execute a

contract in accordance with the

terms of the bid and the bid bond,

and any condition of the City of

Minot, as required by law. A coun-

tersignature of a bid bond is not re-

quired. If the City of Minot elects to

award a contract to the lowest

responsible bidder, and the lowest

responsible bidder does not execute

a contract within the ten days al-

lowed, the bidder’s bond must be

forfeited to the City of Minot and the

project awarded to the next lowest

responsible bidder. Each bidder

must possess a valid North Dakota

contractor’s license for the full

amount of their bid, as required by

Section 43-07-07 of the North Dako-

ta Century Code. Each bidder MUST

enclose a copy of their Contractor’s

License or Certificate of Renewal, is-

sued by the North Dakota Secretary

of State, in their bid bond envelope,

and each license must be valid and

dated at least 10 days prior to the

date set for bid opening, as required

under Section 43-07-12 of the North

Dakota Century Code. No bid may

be read or considered if it does not

fully comply with the requirements of

Section 48-01.2-05 of the North

Dakota Century Code, and any defi-

cient bid submitted will be resealed

and returned to the bidder immedi-

ately. All Bids submitted and all

Work completed must be as stipulat-

ed in the Agreement. The City of

Minot reserves the right to hold all

Bids for a period of 30 days after the

date of the bid opening, to reject any

or all Bids, and to waive any infor-

mality or irregularity in any Bid. For

all further requirements regarding

bid submittal, qualifications, pro-

cedures, and contract award, refer to

the Instructions to Bidders that are

included in the Bidding Documents.

INITIAL RESOLUTION FOR

GENERAL OBLIGATION PARK

FACILITIES BONDS

BE IT RESOLVED by the Board of

Park Commissioners of the Park

District of the City of Minot, North

Dakota, that it is necessary and ex-

pedient for the Park District of the

City of Minot, North Dakota (the

“Park District”) to issue its general

obligation park facilities bonds as

hereafter described:

1. The maximum amount of the

Bonds proposed to be issued is

$3,500,000.

2. The purpose for which the Bonds

are proposed to be issued is to con-

struct park improvements including,

not limited to, Polaris Park improve-

ments, Zoo interior pathways, Leach

parking lot, SHA parking lot, Wood-

land Trail parking lot, Oak Park path-

way, Hoeven sidewalk connection,

Roosevelt Park Pool Waterslide, and

related work and improvements.

3. The assessed valuation of all tax-

able property in the Park District, as

defined in N.D.C.C. Section

21-03-01, is $2,239,220,161, as last

finally equalized for the year 2019.

4. The total amount of bonded in-

debtedness of the Park District, all

issued for park facilities purposes, is

$11,040,000.

BE IT FURTHER RESOLVED that

the General Obligation Park Facili-

ties Bonds shall be issued in accor-

dance with and pursuant to the au-

thority granted to the Park District by

Section 21-03-07(11), N.D.C.C., and

the Park District hereby dedicates

such an amount as is necessary to

provide for the payment of the princi-

pal at maturity and the interest when

due on the Bonds from the tax levy

authorized by Section 21-03-15,

N.D.C.C., which dedication shall

continue in affect and may not be

discontinued by the Park District un-

til the principal and any accrued in-

terest on the Bonds have been paid

in full or defeased in accordance

with the provisions of the resolution

authorizing the issuance of the

Bonds. BE IT FURTHER

RESOLVED that any owner of tax-

able property within the Park District

may, within sixty (60) days after pub-

lication of this Resolution, file with

the Clerk of the Park District a pro-

test against the adoption of this

Resolution. Protests must be in writ-

ing and must describe the property

that is the subject of the protest. If

the Park Board finds the protests

have been signed by the owners of

taxable property having an assessed

valuation equal to five percent (5%)

or more of the assessed valuation of

all taxable property within the Park

District, as last finally equalized, all

further proceedings under this

Resoltion are barred. BE IT FURTH-

ER RESOLVED that the Clerk is

hereby authorized and directed to

cause this Resolution to be pub-

lished in the official newspaper of

the Park District.
