November 19, 2019

The regular meeting of the Ward

County Commission was called to

order by Chair Weppler at 9:00 AM

with Commissioners Walter, Fjel-

dahl, Rostad, and Pietsch present.

Also present were department

heads Betty Braun, Dana Larsen,

Derrill Fick, Jason Blowers, John

Crosby, Kerrianne Boetcher, Leona

Lochthowe, Melissa Bliss, Robert

Roed, Roza Larson, Ryan Kam-

rowski, and Jennifer Wiechmann.

Moved by Comm. Rostad, seconded

Comm. Walter to approved the

agenda. Roll call; all voted yes; mo-

tion carried. Moved by Comm.

Pietsch, seconded by Comm. Ros-

tad to approve the Minutes for the

Regular Commission Meeting on

November 5, 2019. Roll call; all vot-

ed yes; motion carried. Moved by

Comm. Fjeldahl, seconded by

Comm. Walter to approve the regu-

lar bills removing the $7,750.00 from

R&M Painting and Woodworking to-

taling $1,354,242.69 and the Social

Service bills totaling $7,567.36. Roll

call; all voted yes; motion carried.

Moved by Comm. Fjeldahl, second-

ed by Comm. Pietsch to approve

having an end of the year budget

amendment for the Facilities

Management 2020 budget to carry

over the $7,750.00 to cover the

R&M Painting and Woodworking bid

for painting the exterior of the 425

Building. Roll call; all voted yes; mo-

tion carried. Sheriff Robert Roed ap-

peared with a Memorandum of

Understanding between the City of

Minot and Ward County regarding

the FY 2019 Edward Byrne Memori-

al Justice Assistant Grant for the

Commission approval and Chairman

signature. The Minot Police Depart-

ment has applied for this grant,

which is to be shared equally with

the Ward County Sheriff’s Depart-

ment. Ward County Sheriff’s Depart-

ment will purchase a 360 degree

evidence collection camera with

their portion of the grant funds.

Moved by Walter, seconded by

Comm. Rostad to approve and sign

the Memorandum of Understanding

between the City of Minot and Ward

County. Roll call; all voted yes; mo-

tion carried. Social Service Director,

Melissa Bliss appeared with the

Ward County Human Service Zone

Board Agreement for the Commis-

sioners approval. The Agreement

deadline to send it to the state is De-

cember 1, 2019. Ms. Bliss and the

Commissioners reviewed the agree-

ment and discussed some correc-

tions and additions. Moved by

Comm. Fjeldahl, seconded by

Comm. Rostad to adopt the Ward

County Human Service Zone

(WCHSZ) Board Agreement with the

following changes, adding diversity

of members, adding of the board

members’ biographies and minor

spelling and grammar errors. Roll

call; all voted yes; motion carried.

Jason Blowers IT Director appeared

with a request to donate 5 used

County printers to the Burdick Job

Corp. Moved by Comm. Walter,

seconded by Comm. Rostad to ap-

proved the donating of five used

County printers to Burdick Job

Corps. Roll call; all voted yes; mo-

tion carried. Director of Tax Equali-

zation, Ryan Kamrowski appeared

with a Joint Powers Agreement

transferring building permit authority

from the City of Surrey to Ward

County. Moved by Comm. Rostad,

seconded by Comm. Fjeldahl to ap-

prove and sign the Joint Powers

Agreement transferring building per-

mit authority from the City of Surrey

to Ward County. Roll call; all voted

yes; motion carried. Dana Larsen

County Highway Engineer appeared

with two agenda items, the first be-

ing two budget amendments. The

first amendment is to the road con-

struction line item increasing the

budget by $1,050,000 to account for

the 2018 chip seal project that was

carried over and completed in 2019.

The second budget amendment is

the equipment purchasing line item

increasing the budget by $528,000

to account for the 2019 buy back on

the County’s old motor graders.

Moved by Comm. Fjeldahl, second-

ed by Comm. Walter to approve the

two budget amendments for the

Highway Department as presented.

Roll call; all voted yes; motion car-

ried. Mr. Larsen continued with his

second agenda item requesting ap-

proval for payment in the amount of

$73,000 to Budget Equipment to

resolve claims related to Butler

Equipment’s November 2018 motor

grader bid. Moved by Comm.

Pietsch, seconded by Comm. Fjel-

dahl to approve payment in the

amount of $73,000.00 to Butler

Equipment and authorize the Chair

and County Deputy Auditor to exe-

cute the settlement agreement

proved by legal counsel. Roll call; all

voted yes; motion carried. Kjerstie

Fevold, Human Resource Generalist

appeared with the NDPERS Notice

of Appointment of Authorized Agent

or Contact. Moved by Comm.

Walter, seconded by Comm. Pietsch

to authorize Commissioners

Weppler and Fjeldahl as NDPERS

Contacts and to add this to annual

appointments, appointing 2 Com-

missioners, one from each election

cycle. Roll call; all voted yes; motion

Bids will be received as a Unit Price

bid. The Owner intends to award

the Bid based on the base Bid,

a sum equal to five percent (5%) of

the full amount of the Bid, executed

by the Bidder as principal and by a

that if the principal’s Bid is accepted

and the contract awarded to the prin-

cipal, the principal, within ten (10)

days after Notice of Award, shall ex-

ecute and effect a con tract in ac-

cordance with the terms of his Bid

and a Contractor’s Bond as required

by law and the regulations and

determinations of the governing

body. The Bid Bond of the three

lowest Bidders will be retained until

the contract has been awarded and

executed, but not longer than sixty

(60) days. The Bid security is a

guarantee that the Bidder will enter

into contract for the work described

in the Proposal. The bidder may

submit a Bid Bond, certified check,

or cashier’s check payable to the

City of Minot, North Dakota. All

Bidders shall have a valid North

Dakota Contractor’s license of the

appropriate Class for the work, as

required by Section 43-07-05

(NDCC). Bidders shall enclose a

copy of the license or Certificate of

Renewal in the same envelope as

the Bidder’s Bond, as required under

Section 43-07-12 (NDCC). Failure to

do so will render the Bid invalid. Re-

ceipt of all Addenda issued during

bidding shall be acknowledged by

the Bidder on the outside of the Bid

Envelope. Failure to acknowledge

any Addenda issued during bidding

shall render the Bid invalid. No Bid

will be read or considered unless it

fully complies with the Bond and

license requirements. Any deficient

Bid will be resealed and returned to

the Bidder immediately. This project

is being funded by a Minot-HUD

Resiliency Grant. Contractors shall

be required to comply with all appli-

cable federal and state laws and re-

gulations governing the federal grant

program. Attention is called to the

fact that compliance with CDBG-DR

is required on this project and will in-

clude federal labor standards and

Davis Bacon labor rates, Section 3

employment plan, and that the Con-

tractor must ensure that employees

and applicants for employment are

not discriminated against because of

their race, color, religion, sex, or na-

tional origin. The City of Minot is an
