NOTICE IS HEREBY GIVEN that

the State of North Dakota, acting

through the State Water Commis-

sion, invites and will receive sealed

proposals (bids) up to the hour of

2:00 p.m., local time, on September

25, 2019, for the furnishing to the

State of North Dakota of all transpor-

tation, labor, materials, tools, equip-

ment, services, permits, utilities, and

other items necessary to construct

said work, in accordance with the

drawings and contract documents

on file in the office the North Dakota

State Water Commission. At said

time, said proposals will be publicly

opened and read aloud in the North

Dakota State Water Commission lo-

cated at: North Dakota State Water

CommissionState Office Building

900 East Boulevard Avenue

Bismarck, North Dakota

58505-0850. Bids shall conform to

and be responsive to the Contract

Documents for the work. The Con-

tract Documents will be available

after August 30, 2019. Copies of the

Contract Documents will be on file

and may be examined during normal

office hours in the office of the North

Dakota State Water Commission

and at the following locations: Hous-

generally consists of the following:

Mobilization; pump water out of and

exercise existing valves in 111

vaults (58 air release valve

vaultsand 53 blowoff vaults); fill and

pressure test the existing ductile

iron line, flush water out of exist-

ing pipeline blowoffs, and incidental

items. The Contractor will not per-

form work or permit the performance

of Work by subcontractors outside

regular dusk to dawn working

hours or on Saturdays, Sundays,

or legal State holidays without pro-

viding written notice of proposed

work to the Engineer a minimum of

5 days in advance and contingent on

the Owner’s written consent. In ac-

cordance with of the current Energy

and Water Development Appropria-

tions Act, to the greatest extent

practicable, all equipment and pro-

ducts purchased for use in this con-

tract should be American-made.

cations may be obtained following

receipt of payment of $500.00 per

set, non-refundable, or a CD may be

obtained with the documents in elec-

tronic (pdf) format following receipt

of payment of $40 per set, nonre-

fundable, from the following: Hous-

58701-3700. The contract docu-

ments may also be viewed free of

charge online at

www.houstoneng.com, or down-

loaded for a fee of $25.00. Please

ment for Bids, Planholders List, Ad-

dendums, and Bid Results will be

available from the “Bid Info” link lo-

cated on the Houston Engineering,

Inc. web site. Each bid shall be sub-

mitted on a form furnished as part of

the contract documents and must be

accompanied by a separate en-

velope containing a Bidder’s Bond

with Acknowledgement of Surety in

an amount not less than 5% of the

full amount of the bid made payable

to the order of or for the benefit of

the North Dakota State Water

Commission. The bid bond shall be

executed by the bidder as principal

and by a surety company authorized

to do business in the State of North

Dakota, conditioned that if the

principal’s Bid be accepted and the

contract awarded to the principal,

within ten (10) days after Notice of

Award, the Principal shall execute a

contract in accordance with the

terms of the bid and contractor’s

performance and payment bonds as

required by law and the regulations

and determinations of the North

Dakota State Water Commission. A

bid submitted without this informa-

tion properly enclosed in the bid

bond envelope shall not be read nor

considered and the envelope shall

be resealed and bid returned to the

bidder immediately. Each bid shall

be sealed and delivered to the North

Dakota State Water Commission at

the location designated in this notice

for the opening of bidsat or before

the time in this notice provided. Un-

less a bidder obtains a contractor’s

license for the full amount of its bid

within twenty days after it is deter-

mined the bidder is the lowest

responsive and responsible bidder,

the bid must be rejected and the

contract awarded to the next lowest,

responsive, responsible, and

LICENSED bidder. A Pre-Bid

Conference Call with the Engineer

will be held on September 18, 2019

at 2:00 p.m. local time. Attendance

at the pre-bid conference is strongly

encouragedfor all Bidders. The con-

ferencing details are provided in the

Bidding Documents. Interim Mile-

stone Substantial Completion dates

for the WORK are stipulated in the

AGREEMENT (Document No.

00520). Final Completion for all

WORK shall be July 31, 2020. The

State of North Dakota, acting

through the State Water Commis-

sion, reserves the right to select the

schedule(s) under which the bids

are to be compared and contract(s)

awarded, to reject any and all bids,

to determine whether a bidder is

responsive and responsible and to

waive any and all irregularities in

NOTICE

Proposed Ordinance Changes

The Ward County Commissioners

will hold a public hearing on pro-

posed revisions to Chapters 1, 2, 3

and 4 of the Zoning ordinance. The

changes address Zoning Districts 1,

2, 6 and the Ward County Flood-

plain, to address consistency with

and to accomplish the goals and pol-

icies of the Ward County

Comprehensive Plan and any

amendments thereto. A full copy of

the ordinance can be obtained from

the Auditor’s office. The hearing will

be held during their regular commis-

sion meeting which begins at 9:00

am on October 15. The meeting will

be in the commission chambers on

Sawyer 25%. Motion to move

forward-KD, 2nd-MB, MC. Prelim-

inary 2020 Budget went to County

on 8/9. Final Budget hearing will be

Oct. 7th to allow citizens to make

comments. Auditor directs Council

to the water fund in the red for pro-

posed 2020 budget, the infrastruc-

ture is continuing to deteriorate so

repairs will increase due to water

and sewer maintenance projects at

$20,000 each. Funding for these

repairs must be budgeted through

either property tax transfers, special

assessments or increase rates.

Council concurs that the repairs

have to be done. KD asks if money

from the General Fund is still being

transferred to the Highway Fund to

cover shortfalls in revenue receipts.

KD asks how much the tax levy will

increase property taxes=about $50

per $100,000 of value. Discussion

on Special Assessment to each pro-

perty taxes to raise money for the

maintenance of the water and sewer

repairs. Discussion on Sawyer not

qualifying for most grants because

the average income in the communi-

ty is too high=the majority of people

in the community are not low income

families. Bridge Design-graphic pro-

vided to Council with proposed

design. Citizens are encouraged to

contact Legislatures to vote for ap-

propriations. Levee Encroachments-

ED will be attending the meeting and

will be taking photos with her of the

wet & dry side of the levee. She will

also be asking the Corp and the

Board to come to Sawyer to speak

directly with the property owners to

give specific instructions on how to

handle each specific encroachment

identified. Dog complaint received

on Grad & Francis dogs running at

large and barks and/or incessantly

barking. CC asks if the owners can

be fined. Discussion on adding fund-

ing for a Judge into the budget

would be the best use of City funds.

KD suggests that we review the fine

schedule in each ordinance and ad-

just those prior to hiring any Judge.

Council concurs that over the winter

to review the fee schedules. Most

ordinances state that fines can be

up to $500. Discussion on multiple

cars across the street of the Lindsey

home and will cause issues. Dis-

cussion on NO Parking sign up on

that street. Council concurs that is a

good idea. Auditor Update: Discus-

sion on Water Shut-offs. Pancake

Breakfast Proceeds -$382 was col-

lected for the School. Council con-

curs the City should earmark for

flagpoles as a symbol of our govern-

ment. Sept Meeting Date change

due to Auditor being out for

Daughter’s wedding. Motion to hold

meeting on Monday Sept 9th-GA,

2nd-MB, MC. Other Items: Discus-

sion on 325 2nd Ave SW. Water was

shut-off at the property today. KD

states that there are piles of gar-

bage, appliances, etc. in front in the

place. It is causing rodents, feral cat

haven, etc. KD states if they are not

going to clean it the City needs to

clean it and assess the property.

Discussion on 105 3rd St SW.

Trailer needs to be updated or re-

moved. City to hire someone to take

care of the lot and assess the pro-

perty for the cost plus. Motion to Ap-
