BISMARCK (AP) - A North Dakota prison inmate convicted of killing and dismembering a Wisconsin man has lost his appeal over medical treatment at the state penitentiary.
Dennis Gaede, convicted of killing Timothy Wicks in 2001, says he requested a root canal and crown after he cracked a tooth, but the tooth was pulled instead. Gaede accused state officials of cruel and unusual punishment.
A lower court threw out Gaede's original lawsuit in January 2012.
The 8th U.S. Circuit Court of Appeals said in a decision filed Friday that it found no evidence to overturn the judge's ruling.
Gaede is serving a life sentence without parole.
