Woman pleads not guilty in stabbing

BISMARCK (AP) - A Bismarck woman accused of stabbing her brother in the back has pleaded not guilty in district court.

The Bismarck Tribune reports that Rosezina Hayes is charged with felony aggravated assault, which carries a maximum penalty of five years in prison.

A judge found that there was probable cause for the case to move forward during a preliminary hearing on Wednesday, and Hayes' next appearance is scheduled for May 15.

A Bismarck police officer said in a written statement that Hayes said her brother was intimidating and she believed he would hurt her boyfriend.

Burleigh County Assistant State's Attorney Lloyd Suhr says the issue seems to be whether or not Hayes was acting in self-defense, which is an issue for trial.
