David Blue, New Town, charged with simple assault on a correctional officer

David Ellis Blue, 25, New Town, is accused of biting the knuckle of a Mountrail County Jail Correctional Officer when she was trying to subdue him at the jail on Sept. 7. He is charged with a Class C felony in district court in Mountrail County.

According to the affidavit filed with the court by the officer, Terra Gundvig, Blue had become combative and was struggling with two other correctional officers and refusing to obey their commands. She went to assist the other officers and he refused to give her his hand so she could handcuff him. As she was trying to get control of him, he leaned forward and bit her on the knuckle. The bite wound immediately started to bleed.

According to a listing on the North Dakota Courts site, Ellis had initially been arrested and charged on Sept. 7 with lying to law enforcement officers, resisting arrest and ingesting a controlled substance, all Class A misdemeanors.

Blue made an initial appearance on the C felony charge on Monday in district court in Stanley, where bail was set at $2,000 cash or corporate surety.

A preliminary hearing has been scheduled for Nov. 1 before Judge Todd Cresap.
